THIS CAUSE came on for public hearing before the Board upon the Petitioner's Motion for Imposition of
Fines on August 28,2014,and the Code Enforcement Board,having heard argument respective to all appropriate
matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
I. On May 22,2014,Respondent was found guilty of Ordinance 04-41,as amended,the Collier County
Land Development Code,Section 3.05.08(C)for presence of prohibited exotic vegetation,including,but
not limited to,Brazilian Pepper and Ear Leaf Acacia in a Conservation/Water Management Area of the
Madison Meadows Planned Unit Development(PUD). The owner is given the responsibility of exotics
maintenance in Plat Book 19,Page 14. The violation occurred on the real property located at No Site
Address,Bonita Springs,Florida, 34110,Folio 56320000103,more particularly described as 107350 in
Madison Meadows,according to the Plat recorded in Plat Book 19,Pages 14-15,Public Records of Collier
County,Florida.
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before July 23,2014,or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5051,PG 798).
3. Operational costs of$63.74 incurred by the County in the prosecution of this case were ordered to be paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did not
appear at the public hearing,and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
6. The violation has not been abated as of the date of hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162, Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines is Granted.
B. Daily fines of$200.00 per day are assessed against the Respondent for 36 days for the period from July
24,2014 to August 28,2014 for a total amount of fines of$7,200.00.
C. Respondent shall pay the previously assessed operational costs in the amount of$63.74.
D. Respondent shall pay operational costs for the Imposition of Fines hearing in the amount of$62.47.
E. Respondent is ordered to pay fines and costs in the total amount of$7,326.21 or be subject to
Notice of Assessment of Lien against all properties owned by Respondent in Collier County, Florida.
F. The daily fine of$200.00 shall continue to accrue until abatement has been confirmed by a Collier County
Code Enforcement Investigator.

enclosed without permits. Permit by Affidavit PRBD20111005575 was canceled by contractor. The
violation covered the real property located at 4473 18th Place S.W.,Naples, FL 34116,Folio
35758960001,more particularly described as Lot 31, Block 35, GOLDEN GATE, UNIT 2, according to
the plat thereof as recorded in Plat Book 5,Pages 65 to 77 of the Public Records of Collier County.

2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before March 21,2014,or a fine of$200.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 4973,PG 2020,
et. seq.)
3. Operational costs of$63.14 incurred by the County in the prosecution of this case were ordered to be paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did not
appear at the public hearing,and no legal defense to the Motion was presented.
5. A Motion for Extension of Time was granted to July 23,2014.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
7. The violation has not been abated as of the date of hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:

4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did not
appear at the public hearing,and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
6. The violation has not been abated as of the date of hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162, Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines is Granted.
B. Daily fines of$200.00 per day are assessed against the Respondent for 27 days for the period from
October 23,2011 to November 18,2011 for a total amount of fines of$5,400.00.
C. The previously assessed operational costs are$81.15.
D. Respondent is ordered to pay fines and costs in the total amount of$5.481.15 or be subject to
Notice of Assessment of Lien against all properties owned by Respondents in Collier County, Florida.
E. The daily fine of$200.00 shall continue to accrue until abatement has been confirmed by a Collier County
Code Enforcement Investigator.
