SECTION 2
1 ,",1P ROVEM ENTS
Owner shall be permitted to perform the following site preparation and construction
activities subject to thc conditions, limitations, and restrictions contained in S¢ctit)ns 3
through 7 below, as follows:
Clearing of rights-of-way for road and drainage construction and clearing2 ~)f
casements fi~r utility and lake construction. ~
Construction of paving and drainage infkastruclurc within street rights-otkxvay and
ii1 those areas which will serve l~turc residential areas, to include but not limited
to subgradc, base. asphalt, storm pipe, hcadwalls, inlets, and sidewalks.
Construct/on of [nl?astructurc to include water, sewer, irriualhm mains, and sewer
pump stations. ~
The prcliminaD, work detailed in this Section shall bc in accordancc with plans entitled
Ventura. Wilson Miller, Ba~on & Peck, Inc.. Drawing l:ilc Nt>. I)-0136-33. sheet
numbers I through 13. dated February. 1999. hcrcinalier collectively referred to :ts thc

SF. CTION 4
A I'lq;IOVA
County will issue thc Preliminary Work Permits to permit tile l'reliminarv ",Vork prior to plat
approval once conditions (a) through (c) in Section 3 above have been satisfied. Owner
understands that no building permit will be issued lbr habitable structures within Vcntura until
the plat is approved and recorded.
SECTION 5
INI)E,MNIFICATION
Owner agrees to laden'mi fy and hold CounD, harmlcss against any and all liability, loss, damage
or expense from claims or causes of action including attorneys l~cs and court costs, resulting
from, arising out oL and in connection with Owner's negligence and/or willful misconduct in thc
construction of thc l'reliminary Work under thc Preliminary Work l'crmits or any challenge by
any person or party objecting to the legality or validity o/tiffs Agreement.
SECTION 6
RESTRICTIONS
This Agreement shall be binding upon thc parties and is not transl'crabtc.
SECTION 7
I.IMII'A'FIONS
This Agreement shall expire thirty (30) days from thc date of the issuance of thc F'reliminary
Work Permits if thc pr0ject's final plat is not submitted to the Board of C'~mnty ConunissJoncr's
for approval pursuant to I)ivision 3.2 of the I,and I)evclopmcm C'odc. unless thc Owner is
delayed in having his final plat reviewed by thc ltoard due to thc fault of tile County. All work
approved by this Agreement must cease and not restart it' thc final plat is not submitted and

approved by the Board of County Commissioners within this authorization period. No work is
authorized under this Agreement prior to satisfying tile conditions (a) through (c) itl Section 3 of
this Agreement. Any attempt to commence work prior to issuance of requisile permits shall
render all provisions of this Agreement null and void.
lSy entering into this Agreement the County does not guarantee and the Owner cannot rely upon
the fact that the project's final plat will be approved upon submissi,m to the Board of County
Commissioners. The Owner is required to comply with all of the pn,visions and procedures of
the Land I)evelopment Code before the final plat can be su~,mitted to the Board for
consideration.
