The Honorable Special Magistrate Brenda Garretson called the Hearing to order at 9:00 A.M.

Mr. Benitez was present and testified:
• On June 10, 2014 he was contacted via telephone by an individual he thought
was a friend of a friend for a ride from Macy's to Golden Gate.
• He is retired, and provides transportation for friends when they are in need and
requests gas money for the ride.
• He quoted a fee of$20.00 and proceeded to the scene where the Investigators
approached him and issued a Citation.
• He requested the amount of the Citation be reduced.
Investigator Short testified:
• He called the phone number listed in the Craigslist advertisement and spoke to a
man on the phone and requested a ride from Macy's to Golden Gate.
• The individual quoted a fee of$20.00 for the ride and reported his wife would
provide the service.
• He received a call back whereby the man on the telephone informed he would
provide the service and confirmed a fee of$20.00.
• When Mr. Benitez arrived on scene he was not in possession of the required
Collier County identification for providing a Vehicle for Hire Service.
• Accordingly,the Citation was issued.
Investigator Lopez-Silvero testified when Mr. Benitez arrived at the scene,he confirmed
he was the individual on the phone he spoke with and confirmed a fee amount of$20.00.
Mr. Benitez testified it is his phone number in the Craigslist advertisement however he
did not place the advertisement and names listed as a contact are not his or his wife's.
He has subsequently changed his phone number.
Supervisor Snow recommended the Respondent be responsible for the Operational Costs
and Administrative Fee and Mr. Benitez enter a stipulation to not provide any future
Vehicle for License services without proper licensing or a Citation will be issued, along
with a civil penalty.
The Special Magistrate found the Respondent GUILTY and ordered him to enter into a
Stipulation as outlined above and pay Operational Costs in the amount of$50.00 and a
