OF LAW AND ORDER OF THE BOARD
THIS CAUSE came on for public hearing before the Board on June 20,2014,and the Board,having heard
testimony under oath,received evidence,and heard respective to all appropriate matters,thereupon issues its
Findings of Fact,Conclusions of Law,and Order of the Board,as follows:
1. That 4463 East Trail LLC is the owner of the subject property.
2. That the Code Enforcement Board has jurisdiction of the person of the Respondent and that the
Respondent,having been duly notified,failed to appear at the public hearing.
3. That the Respondent was notified of the date of hearing by certified mail and by posting.
4. That the real property located at no site address,Naples,Florida,Folio 393920004(Legal Description: 13
50 25 COMM AT SE CNR,N 149.72FT,N39 DEG W1450.65 FT TO POB,N39 DEG W 35FT,N50 DEG
E400FT, S39 DEG E 200FT)is in violation of Collier County Code of Laws and Ordinances,Chapter 54,Article
VI, Section 54-185(d)in the following particulars:
Collier County prohibited exotic vegetation located upon an unimproved property within a 200 foot
radius of an improved property.
5. The violation has not been abated as of the date of the public hearing.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law and based on the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. That the Respondent is in violation of Collier County Code of Laws and Ordinances,Chapter 54,
Article VI, Section 54-185(d).
2. That the Respondent must obtain any necessary permits,inspections,and Certificate of Completion
for the removal of all Collier County prohibited exotic vegetation within 30 days(July 20,2014)or a fine of
$100.00 per day will be imposed until the violation is abated.The prohibited exotic vegetation base/stump must be
treated with an U.S.Environmental Protection Agency approved herbicide and a visual tracer dye shall be applied
when the prohibited exotic vegetation is removed but the base of the vegetation remains.
3. If the Respondent fails to comply with this Order,the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
4. The Respondent is ordered to pay all operational costs incurred in the prosecution of this
Case in the amount of$64.64 within 30 days(July 20,2014).
5. Respondent shall notify the Code Enforcement Investigator within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

4. That the real property located at 2883 50th Terrace S.W.,Naples,Florida, 34116,Folio 36451600007,
more particularly described as Lot 1,Block 260,GOLDEN GATE UNIT NO.7,according to the map or plat
thereof,as recorded in Plat Book 5,Page 135 of the Public Records of Collier County,Florida of the Public
Records of Collier County,Florida is in violation of Ordinance 04-41,as amended,the Collier County Land
Development Code, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e)and 10.02.06(B)(1)(e)(i)in the following
particulars:
Building a rear dock without the proper Collier County permits.
5. The violation has not been abated as of the date of the public hearing.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law,to the Stipulation attached hereto and
incorporated herein,and based on the authority granted in Chapter 162,Florida Statutes,and Collier County
Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. That the Respondents are in violation of Ordinance 04-41,as amended,the Collier County Land
Development Code, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e)and 10.02.06(B)(1)(e)(i).
2. That the Respondents must abate all violations by obtaining all required Collier County building
permits or demolition permit,inspections and Certificate of Completion/Occupancy within 120 days(October 18,
2014)or a fine of$200.00 per day will be imposed until the violation is abated.
3. If the Respondents fail to comply with this Order,the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If necessary,the County may
,
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
4. The Respondents are ordered to pay all operational costs incurred in the prosecution of this

STIPULATION/AGREEMENT
COMES NOW, the undersigned, Roesmel Rua, on behalf of himself and as representative for De La O. Yislen,
and enters into this Stipulation and Agreement with Collier County as to the resolution of Notices of Violation in
reference (case) number CESD20140005957 dated the 25th day of March, 2014.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for June 20th, 2014; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $63.44 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by: Obtaining all required Collier County Building Permit(s) or Demolition
Permit, Inspections, and Certificate of Completion/Occupancy within 120 days of this hearing or
a fine of$200.00 per day will be imposed until the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the,violati n into compliance and may use the assistance of the Collier County Sheriff's Office

THIS CAUSE came on for public hearing before the Board on May 22,2014,and the Board,having heard
testimony under oath,received evidence,and heard respective to all appropriate matters,thereupon issues its
Findings of Fact,Conclusions of Law,and Order of the Board,as follows:
1. That Ivy E.Peden is the owner of the subject property.
2. That the Code Enforcement Board has jurisdiction of the person of the Respondent and that the
Respondent,having been duly notified,appeared at the public hearing in person.
3. That the Respondent was notified of the date of hearing by certified mail and by posting.
4. That the real property located at 5781 Dogwood Way,Naples,Florida, 34116,Folio 38339680008,more
particularly described as the West 180 feet of Tract 92,GOLDEN GATE ESTATES,UNIT NO. 33,according to
the Plat in Plat Book 7,Page 60,of the Public Records of Collier County,Florida is in violation of Ordinance 04-
41,as amended,the Collier County Land Development Code, Section 3.05.08(C)in the following particulars:
Presence of prohibited exotic vegetation.
5. The violation has not been abated as of the date of the public hearing.
AMENDED ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law and based on the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. That the Respondent is in violation of Ordinance 04-41,as amended,the Collier County Land
Development Code,Section 3.05.08(C).
2. That the Respondent must obtain any necessary permits, inspections,and Certificate of Completion
for the removal and/or felling in place of all Collier County prohibited exotic vegetation within 360 days(May 22,
2015)or a fine of$50.00 per day will be imposed until the violation is abated.
3. The Respondent shall submit a quarterly update to the Code Enforcement Department.

4. If the Respondent fails to comply with this Order,the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
5. The Respondent is ordered to pay all operational costs incurred in the prosecution of this
Case in the amount of$64.04 within 30 days(June 21,2014).
1 6. Respondent shall notify the Code Enforcement Investigator within 24 hours of abatement or
compliance so that a fmal inspection may be performed to confirm compliance.

Findings of Fact and Order as follows:
FINDINGS OF FACT
1. On March 27,2014,Respondents were found to be in violation of Ordinance 04-41,as amended,the
Collier County Land Development Code, Section 10.02.06(B)(1)(A),which violation covered the real property
located at 59 Moorhead Manor,Naples,Florida 34112,Folio 60583400002(Legal Description:MOORHEAD
MANOR(COOP)LOT 59).
2. An Order was entered on March 31,2014,which was recorded in the Public Records of Collier
County,Florida at OR 5025,PG 157,et. seq.on April 9,2014.
3. An Affidavit of Compliance was filed with the Board by the Code Enforcement Official on June 16,
2014,which Affidavit certified under oath that the required corrective action has been taken as ordered.
4. The violation has been abated as of the date of the hearing.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the
Respondents to correct the violation;(c)whether there were previous violations committed by the violator;(d)the
cost upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)the
value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would cause on the
Respondent;(h)the time and cost incurred by Code Enforcement to have the violation corrected and(i)any other
equitable factors which would make the requested mitigation appropriate.

ORDER ABATING FINE/LIEN
THIS CAUSE came on for public hearing before the Board upon the Petitioner's Motion to Abate Fines/Liens on
June 20,2014,and the Board,having heard argument respective to all appropriate matters thereupon issues its
Findings of Fact and Order as follows:
FINDINGS OF FACT
1. On January 23,2014,Respondents were found to be in violation of Ordinance 04-41,as amended,the
Collier County Land Development Code,Section 10.02.06(B)(1)(a),which violation covered the real property
located at 221 1St Street,Bonita Springs,Florida 34134,Folio 55851360009,more particularly described as Lot 7,
Block B,of that certain subdivision known as LITTLE HICKORY SHORES,UNIT 1,according to the map or plat
thereof on file and recorded in the office of the Clerk of the Circuit Court of Collier County,Florida,in Plat Book
3,page 6.
2. An Order was entered on February 5,2014,which was recorded in the Public Records of Collier
County,Florida at OR 5014,PG 3050 et.seq.on March 7,2014.
3. An Affidavit of Compliance was filed with the Board by the Code Enforcement Official on May 28,
2014,which Affidavit certified under oath that the required corrective action has been taken as ordered.
4. The violation has been abated as of the date of the hearing.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the
Respondents to correct the violation;(c)whether there were previous violations committed by the violator;(d)the
cost upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(1)the
value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would cause on the
Respondent;(h)the time and cost incurred by Code Enforcement to have the violation corrected and(i)any other
equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
Petitioner's Motion to Reduce/Abate Fines is granted.

ORDER RESCINDING PRIOR ORDERS
THIS CAUSE came on for public hearing before the Board on June 20,2014 on the County's Motion to
Rescind Prior Orders. The Board heard testimony under oath respective to all appropriate matters,and thereupon
issues its Findings of Fact,Conclusions of Law,and Order of the Board,as follows:
1. That Findings of Fact,Conclusions of Law and Order of the Board were issued on November 22,2011 ,
and recorded as OR 4744,PG 1086 on December 8,2011.
2. That an Order Imposing Fine/Lien was issued on October 3,2013,and recorded as OR 4973,PG 2086 on
October 9,2013.
3. That the Orders covered the real property located at 1001 Silver Lakes Blvd.,Naples,FL 34114,Folio
73625009662,more particularly described as the west 300 feet of that portion of Tract CR5 of Silver Lakes,Phase
Two-C according to the plat thereof recorded in Plat Book 27,Pages 74 and 75,which lies South of the Florida
Power and Light Easement described in Official Records Book 831,Page 1472,all of the Public Records of Collier
County,Florida.
4. That an Affidavit of Compliance was filed on April 14,2014 indicating that the corrective action was taken
on June 13,2012.
5. That both Orders should be rescinded.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law,and to the authority granted in Chapter
162,Florida Statutes,and Collier County Ordinance No.04-41,it is hereby ORDERED:
That the Order of November 22,2011,recorded as OR 4744,PG 1086 on December 8,2011 and the Order
Imposing Fine/Lien of October 3,2013,recorded as OR 4973,PG 2086 are hereby rescinded.
