The setback from the northern property line shall be 35 feet. 2. The required landscape buffer along the northern property line shall be 10 feet wide with LDC Alternative B Buffer Plantings. V. Amplified Sound: The use of amplified sound shall be limited to 8:00 AM to 10:00 PM. VI. Unified Design Theme: The project will be developed, whether through a platted subdivision or through a Site Development Plan, with the following: • Shared access from Collier Boulevard; • Shared stromwater management design; • Lighting designed and shielded to prevent spillage or glare on adjacent parcels; • Common architectural, landscaping and signage design theme. VII. Notice of Proximity to Florida Sports Park: The developer, its successor or assignee, shall provide to any potential resident of an approved ALF, or similar facility allowing residential habitation, a disclosure statement with respect to the noise that is associated with the Swamp Buggy Races located at 8250 Collier Boulevard, Naples, Florida within the Florida Sports Park (within the Hacienda Lakes PUD) as it relates to the location of this property. The statement shall disclose that the Florida Sports Park and Swamp Buggy operations regularly generate noise which may be heard on the rezoned C-4 property, both during the day and into the evening, including but not limited to, noise from swamp buggy racing, tractor pulls, festivals , and music concerts. This statement must be presented to the resident prior to entering into any contract. Within 120 days of approval of this rezone, the owner shall record in the public records of Collier County a notice of proximity to the Florida Sports Park and Swamp Buggy grounds. This will close off the Gulf to many property owners in the Haldeman Creek area. My wife and I bought a fixer upper from an owner in Royal Harbor. We frequently take our small boat up the creek to visit friends and go out to the bay for sunsets. The creek is one of the prettiest and most peacefull boat rides in the area. It is all no wake and the mangroves are awesome. Even the Land Yacht Harbor is pretty cool. The creek can be tricky for inexperienced boaters. Wind and currents can move a boat out of it's intended path if the driver isn't careful or the engine loses power. The creek is a natural flyway for birds and us fishermen like to shake the mangroves for bait critters that live in them. I understand that the creek may not be able to stay undeveloped, but so far there is not a lot of dockage allowed on the creek. Most dockage is on the feeder canals. I understand that the developer wants special permission to build more docks and to extend farther into the creek than the law allows. I understand that a person must show a hardship and have no other alternatives before they get special permission. I don't think this developer deserves a variance. There are already a few of those offshore racer type of boats that go up and down the creek. If this proposed dockominiums allow that type of boat, well there goes the neighborhood with that awfull rumble of the engines. Please keep the rights or the neighbors formost when deciding if you should do the developer any favors. We love the old Florida feel of the Gulf Shores neighborhood including navigating the natural beauty of Haldeman Creek out to Naples Bay. Even though we are strong supporters of economic development, we are firm believers of smart development similar to the way the rest of Naples has been developed where it preserves the natural beauty of the area in benefit of all the parties including the current residents and any future residents. We believe that given the nature of how the high and low tides affect this fragile and delicate waterway we do not support the building of boat slips along Haldeman Creek because: (1) it could have adverse environmental impacts by having to trim back the mangroves and potentially creating a dangerous navigation bottleneck given that the waterway is just a creek and not a river; and, (2) the developer should follow the same rules like the rest of the residents where we can only have parallel boat slips. What makes the developer different than the rest of us? They should not be allowed to build perpendicular boat slips but rather parallel boat slips like everyone else. An alternate solution or compromise would be to allow the developer is to expand the existing dock area by the bay where Windstar has additional room. In our opinion the CCPC should facilitate a win win situation for all residents and not just a few new residents by either coming up with an alternate solution or compromise, or by postponing the hearing to the high season this coming winter when the greatest number of residents can be present to discuss this important issue affecting all the residents of this neighborhood. We sincerely hope our comments and input will be taken into consideration and that they be reflected in the minutes of the hearing.
