THIS CAUSE came on for public hearing before the Board upon the Respondent's Motion to Abate Fines/Liens on
May 22,2014,and the Board,having heard argument respective to all appropriate matters
thereupon issues its Findings of Fact and Order as follows:
FINDINGS OF FACT
1. On March 27,2014,Respondents were found to be in violation of Collier County Code of Laws and
Ordinances,Chapter 22,Buildings and Building Regulations,Article VI,Property Maintenance Code, Section 22-
231(12)(i),(12)(n)and(20),which violation covered the real property located at 478 Cypress Way E.,Naples,
Florida 34110,Folio 65420400005,more particularly described as Lot 10,Block G,PALM RIVER ESTATES,
UNIT 5,according to the plat thereof,recorded at Plat Book 10,Page 92,in the Public Records of Collier County,
Florida.
2. An Order was entered on March 31,2014,which was recorded in the Public Records of Collier
County,Florida at OR 5025,PG 145,et.seq.on April 9,2014.
3. An Affidavit of Compliance was filed with the Board by the Code Enforcement Official on April 28,
2014,which Affidavit certified under oath that the required corrective action has been taken as ordered.
4. The violation has been abated as of the date of the hearing.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the
Respondents to correct the violation;(c)whether there were previous violations committed by the violator;(d)the
cost upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)the
value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would cause on the
Respondent;(h)the time and cost incurred by Code Enforcement to have the violation corrected and(i)any other
equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
Respondent's Motion to Reduce/Abate Fines is granted.

2. That the Code Enforcement Board has jurisdiction of the person of the Respondent and that the

3. That the Respondent was notified of the date of hearing by certified mail and by posting.
4. That the real property located at 5781 Dogwood Way,Naples,Florida, 34116,Folio 38339680008,more
particularly described as the West 180 feet of Tract 92,GOLDEN GATE ESTATES,UNIT NO.33,according to
the Plat in Plat Book 7,Page 60, of the Public Records of Collier County,Florida is in violation of Ordinance 04-
41,as amended,the Collier County Land Development Code, Section 3.05.08(C)in the following particulars:
Presence of prohibited exotic vegetation.
5. The violation has not been abated as of the date of the public hearing.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law and based on the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. That the Respondent is in violation of Ordinance 04-41,as amended,the Collier County Land
Development Code, Section 3.05.08(C).
2. That the Respondent must obtain any necessary permits, inspections,and Certificate of Completion
for the removal of all Collier County prohibited exotic vegetation within 360 days(May 22,2015)or a fine of
$50.00 per day will be imposed until the violation is abated.
3. The prohibited exotic vegetation base/stump must be treated with an U.S.Environmental Protection
Agency approved herbicide and a visual tracer dye shall be applied when the prohibited exotic vegetation is
removed but the base of the vegetation remains within 360 days(May 22,2015)or a fine of$50.00 per day will be
imposed.
4. The Respondent shall submit a quarterly update to the Code Enforcement Department.
5. If the Respondent fails to comply with this Order,the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
6. The Respondent is ordered to pay all operational costs incurred in the prosecution of this
Case in the amount of$64.04 within 30 days(June 21,2014).
7. Respondent shall notify the Code Enforcement Investigator within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

more particularly described as 107350 in Madison Meadows,according to the Plat recorded in Plat Book 19,Pages
14-15,Public Records of Collier County,Florida is in violation of Ordinance 04-41,as amended,the Collier
County Land Development Code,Section 3.05.08(C)in the following particulars:
Presence of prohibited exotic vegetation,including,but not limited to,Brazilian Pepper and Ear Leaf
Acacia in a Conservation/Water Management Area of the Madison Meadows Planned Unit Development(PUD).
The owner is given the responsibility of exotics maintenance in Plat Book 19,Page 14.
5. The violation has not been abated as of the date of the public hearing.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law and based on the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. That the Respondent is in violation of Ordinance 04-41,as amended,the Collier County Land
Development Code, Section 3.05.08(C).
2. That the Respondent must remove all Collier County prohibited Exotic vegetation that exists within
the Conservation/Water Management area for Madison Meadows. When prohibited Exotic vegetation is removed,
but the base of the vegetation remains,the base shall be treated with a U.S.Environmental Protection Agency
approved herbicide and a visual tracer dye shall be applied within 60 days(July 23,2014)or a fine of$200.00 per
day will be imposed until the violation is abated.
3. If the Respondent fails to comply with this Order,the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
4. The Respondent is ordered to pay all operational costs incurred in the prosecution of this
Case in the amount of$63.74 within 30 days(June 21,2014).

THIS CAUSE came on for public hearing before the Board on May 22,2014 on the County's Motion to
Rescind Prior Order. The Board heard testimony under oath respective to all appropriate matters,and thereupon
issues its Findings of Fact,Conclusions of Law,and Order of the Board,as follows:
I. That Findings of Fact,Conclusions of Law and Order of the Board were issued on July 27,2010 and
recorded as OR 4591,PG 1642 on August 2,2010 and corrected nunc pro tunc on November 5,2010 and recorded
as OR 4623, PG 1790 on November 12,2010.
2. That the Order covered the real property located at 3131 Tamiami Trail E.,Naples, Florida 34112, Folio
61842240009,more particularly described as N G+T C L F NO 2 11 50 25 FROM NE COR LOT 125 RUN S ON

Florida.
3. That the Order should be rescinded.

OF LAW AND ORDER OF THE BOARD

THIS CAUSE came on for public hearing before the Board on October 24,2013,and the Board,having heard
testimony under oath,received evidence,and heard respective to all appropriate matters,thereupon issues its
Findings of Fact,Conclusions of Law,and Order of the Board,as follows:
1. That Raquel Betancourt is the owner of the subject property.
2. That the Code Enforcement Board has jurisdiction of the person of the Respondent and that the
Respondent,having been duly notified,failed to appear at the public hearing.
3. That the Respondent was notified of the date of hearing by certified mail and by posting.
4. That the real property located at No site address,Folio 41445160001,more particularly described as the
North 150 feet of Tract 55,of GOLDEN GATE ESTATES,Unit 90,according to the plat thereof,as recorded in
Plat Book 5,at Page 29 of the Public Records of Collier County,Florida,is in violation of Ordinance 04-41,as
amended,the Collier County Land Development Code,Section 3.05.01(B)in the following particulars:
Active clearing of native vegetation on unimproved parcel.
ORDER OF THE BOARD
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2010-04,it is hereby ORDERED:
That the violations of Ordinance 04-41,as amended,the Collier County Land Development Code, Section
3.05.01(B)be corrected in the following manner:
1. By submitting a restoration plan pursuant to Collier County Land Development Code Section
10.02.06(E)(3)or by obtaining all applicable Collier County Permits within 90 days(January 22,2014)or a
fine of$150.00 per day will be imposed until the violation is abated.
2. If the Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
3. The Respondent is ordered to pay all operational costs incurred in the prosecution of this
Case in the amount of$82.00 within 30 days.
4. Respondent shall notify the Code Enforcement Investigator within 24 hours of abatement or compliance so
that a final inspection may be performed to confirm compliance.
