The Special Magistrate found the Respondent GUILTY of the alleged violation and ordered
to:
1. Abate all violations by obtaining all required Collier County Building Permit(s) or Collier
County Demolition Permit(s) and required inspections and Certificate of
Occupancy/Completed by July 2, 2014 or a fine of$100.00 per day will be imposed until
the violation has been abated thereafter unless altered by a subsequent Stipulation or
Order of the Special Magistrate.
2. Notify Code Enforcement within 24 hours of abatement of the violation and request the
Investigator perform a site inspection to confirm compliance 24 hours. Notice shall be by
phone and made during the work week. If the violation is abated 24 hours prior to a
Saturday, Sunday or legal holiday, then the notification must be made on the next day that
is not a Saturday, Sunday or legal holiday.

3. If the Respondent fails to abate the violation the County may abate the violation using any
method to bring the violation into compliance and may use the assistance of the Collier
County Sheriffs Office to enforce the provisions of this agreement and all costs of
abatement shall be assessed to the property owner.

Mr. Blanco testified:
• On April 4, 2014 in the evening he was at an establishment handing out taxi service
business cards for his fiancé's family business.

• There is a lighted sign in the rear of his personal vehicle which also advertises the
service.
• The phone number on the sign is not his personal phone number and direct callers to
contact the business advertised for taxi service.
• He was outside the establishment in his vehicle when Investigator Musse, dressed in plain
clothes, approached requesting a ride to another establishment.
• He recognized the Mr. Musse as a County employee and was willing to give him a ride to
help him out as a friend.
• He requested $5.00 dollars be paid for"gas" money.
• Investigator Musse informed him of his position,produced his badge and requested his
driver's license and vehicle registration.
• Now, unsure of the Mr. Musse's intentions, he drove away to a nearby location and called
the Sheriffs Office to report the incident.
• The Sheriff's Office personnel responded to the scene and he was issued a citation by the
Investigator for operating a vehicle for hire without the proper licensing.
• He was simply trying to do Mr. Musse a favor when he requested a ride.
Investigator Musse testified:
• On the evening of April 4, 2014, he was on the scene conducting a"sting operation."
• He approached Mr. Blanco's vehicle and requested a ride to another location.
• Mr. Blanco was willing to give him a ride in exchange for$5.00 in"gas money."
• He displayed his badge and requested Mr. Blanco's Driver's License and vehicle
registration.
• Mr. Blanco fled the scene so he called the Sheriff's Department to report the incident.
• Sheriffs Department personnel responded to the call and accordingly a citation was
issued.
• Mr. Blanco previously held a license to operate a Vehicle for Hire and should be aware
on the requirements in the ordinance for providing transportations services for a fee of
any nature.
After hearing the testimony and reviewing the evidence, the Special Magistrate UPHELD the
issuance of the Citation and ordered the Respondent to pay a Fine in the amount of$500.00,
Operational Costs in the amount of$50.00 and a $5.00 Administrative Fee by July 2, 2014.

Fred Thomas,Jr. was present and testified:
• It was brought to his attention the County was investigating a complaint that a shed
was placed on his property without the proper permits.
• He purchased the property in question in 1996 and the shed was on site at that time.
• During the course of the investigation, a permit could not be produced for placement
of the shed.
• He speculates a permit was issued, through the Immokalee Planning Commission
who had previous jurisdiction of the area, however many of their records cannot be
located.
• The shed is located at the side/rear of the property approximately 9 feet from a fence
which until recently, was assumed to be the property line between his property and
the church property.
• Further investigation revealed the shed encroaches on the church property as the
fence was installed by the church on their property, not on the property line.
• The shed violates the required County setback, so Mr. Thomas ascertained a lease
from the church for the area required to create a conforming setback.
Investigator Walker testified:
• The investigation began as a result of an anonymous complaint.
• The investigation revealed the shed was placed on the property around 1995, but no
permit can be produced authorizing placement of the structure.
• The lease obtained by Mr. Thomas from the church rectifies the issue of a non
conforming setback.
• A permit is required for the shed including issuance of a Certificate of
Completion/Occupancy.
• The shed is rated for a 120 mph wind, which was the requirement when the shed was
placed, however the code has changed and any permit issued will need to conform to
a higher wind load
After hearing the testimony and reviewing the evidence, the Special Magistrate took the case
