THIS CAUSE came on for public hearing before the Board upon the Petitioner's Motion for Imposition
Fines/Liens on April 24,2014,and the Board,having heard argument respective to all appropriate matters
thereupon issues its Findings of Fact and Order as follows:
FINDINGS OF FACT
1. On November 22,2013,Respondent was found to be in violation of Ordinance 04-41,as amended,
the Collier County Land Development Code,Sections 10.02.06(BX1Xa)and 10.02.06(B)(IXe)(i),which violation
covered the real property located at 3745 Randall Blvd.,Naples,Florida 34120,Folio 40183520001,more
particularly described as the East 75 feet of the East 150 feet of Tract 103,Unit 68,GOLDEN GATE ESTATES,
according to the plat thereof,recorded in Plat Book 5,Page 90,of the Public Records of Collier County,Florida.
2. An Order was entered on January 6,2014,which was recorded in the Public Records of Collier
County,Florida at OR 5002,PG 1020,et.seq.on January 22,2014.
3. An Affidavit of Non-Compliance was filed with the Board by the Code Enforcement Official on
March 12,2014,which Affidavit certified under oath that the required corrective action has not been taken as
ordered.
4. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. Petitioner's Motion for Imposition of Fines/Liens is granted.
2. Daily fines of$500.00 per day are assessed against the Respondent for 123 days for the period from
December 23,2013 to April 24,2014 for a total amount of fines of$61,500.00.
3. The previously assessed operational costs of$80.86 have not been paid. The operational costs are
$62.54 for this hearing.
4. Respondent is ordered to pay fines and costs in the total amount of$61,643.40 or be subject to Notice
of Assessment of Lien against all properties owned by Respondent in Collier County,Florida.

Yarberry Lane,Naples,Florida 34109,Folio 237280004,more particularly described as the South V2 of the South
V2 of the Northwest'/ of the Southwest 1/4 of the Southeast'/4 of Section 2,Township 49 South Range 25 East,
Collier County,Florida,LESS and excepting the East30 feet thereof for road right-of-way purposes.
2. An Order was entered on February 5,2014,which was recorded in the Public Records of Collier
County,Florida at OR 5014,PG 3053,et.seq.on March 7,2014.
3. An Affidavit of Compliance was filed with the Board by the Code Enforcement Official on April 23,
2014,which Affidavit certified under oath that the required corrective action has been taken as ordered.
4. The violation has been abated as of the date of the hearing.
5. The previously assessed operational costs of$101.62 have not been paid.
6. The Board considered the following(a)the gravity of the violation;(b)actions taken by the
Respondents to correct the violation;(c)whether there were previous violations committed by the violator;(d)the
cost upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)the
value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would cause on the
Respondent;(h)the time and cost incurred by Code Enforcement to have the violation corrected and(i)any other
equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
1. Petitioner's Motion for Imposition of Fines/Liens is granted.
2. Daily fines of$300.00 per day are assessed against the Respondent for 60 days for the period from
February 23,2014 to April23,2014 for a total amount of fines of$18,000.00.
3. The previously assessed operational costs of$101.62 have not been paid.
4. Respondent is ordered to pay fines and costs in the total amount of$18,101.62 or be subject to Notice
of Assessment of Lien against all properties owned by Respondent in Collier County,Florida.
