THIS CAUSE came on for public hearing before the Board upon the Petitioner's Motion for Imposition
Fines/Liens on February 27,2014,and the Board,having heard argument respective to all appropriate matters
thereupon issues its Findings of Fact and Order as follows:
FINDINGS OF FACT
1. On October 24,2013, Respondent was found to be in violation of Collier County Code of Laws and
Ordinances,Chapter 22, Buildings and Building Regulations,Article VI, Property Maintenance Code, Section 22-
231(12)(b),which violation covered the real property located at 834 93`d Avenue N.,Naples, Florida 34108; Folio
62713320002,more particularly described as Lot 39, Block 53,of that certain subdivision known as NAPLES
PARK, UNIT NO.4,according to the map or plat thereof on file and recorded in the office of the Clerk of the
Circuit Court of Collier County, Florida,in Plat Book 3,page 7.
2. An Order was entered on October 24,2013,which was recorded in the Public Records of Collier
County, Florida at OR 4982, PG 2954,et. seq. on November 12, 2013.
3. An Affidavit of Non-Compliance was filed with the Board by the Code Enforcement Official on
January 6,2014,which Affidavit certified under oath that the required corrective action has not been taken as
ordered.
4. No Request for Re-hearing or Appeal pursuant to Ordinance 2010-04 has been timely filed.
5. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162, Florida
Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
1. Petitioner's Motion for Imposition of Fines/Liens is granted.
2. Daily fines of$150.00 per day are assessed against the Respondent for 66 days for the period from
December 24,2013 to February 27,2014 for a total amount of fines of$9,900.00.
3. The previously assessed operational costs of$81.43 have not been paid. The operational costs for this
hearing are$62.54.
4. Respondent is ordered to pay fines and costs in the total amount of$10,043.97 or be subject to Notice
of Assessment of Lien against all properties owned by Respondent in Collier County, Florida.
5. The daily fine of$150.00 shall continue to accrue until abatement has been confirmed by a Collier
County Code Enforcement Investigator.

hearing are$63.14.
5. Respondent is ordered to pay fines and costs in the total amount of$122,543.43 or be subject to Notice
of Assessment of Lien against all properties owned by Respondent in Collier County, Florida.

5. The previously assessed operational costs of$81.15 have not been paid.
6. The Board considered the following(a)the gravity of the violation;(b)actions taken by the
Respondents to correct the violation;(c)whether there were previous violations committed by the violator;(d)the
cost upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)the
value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would cause on the
Respondent;(h)the time and cost incurred by Code Enforcement to have the violation corrected and(i)any other
equitable factors which would make the requested mitigation appropriate.

Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162, Florida
Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
