The Honorable Special Magistrate Brenda Garretson called the Hearing to order at 9:00 A.M. All those

The Stipulation was entered into by the Respondent Martin Kupick on March 7, 2014.
The Special Magistrate found the Respondent GUILTY of the alleged violation and ordered
to:
1. Pay Operational Costs in the amount of$115.55 incurred in the prosecution of the case by
April 7, 2014.
2. Abate all violations by obtaining and affixing a current valid license plate to each vehicle
not stored within the confines of a completely enclosed structure, and/or repair the defects
so each vehicle is immediately operable or remove offending vehicles from residentially
zoned area by March 28, 2014 or a fine of$50.00 a day will be imposed until the violation
is abated.

3. Cease and decist use of Estates zoned property as storage for semi trucks and trailers not
owned by the property owner or resident at this address and remove all vehicles to a place
intended for such storage use by March 28, 2014 or a fine of$50.00 will be imposed until
the violation is abated.
4. Notify Code Enforcement within 24 hours of abatement of the violation and request the
Investigator perform a site inspection to confirm compliance 24 hours. Notice shall be by
phone and made during the work week. If the violation is abated 24 hours prior to a
Saturday,Sunday or legal holiday, then the notification must be made on the next day that
is not a Saturday, Sunday or legal holiday.
5. If the Respondent fails to abate the violation the County may abate the violation using any
method to bring the violation into compliance and may use the assistance of the Collier
County Sheriff's Office to enforce the provisions of this agreement and all costs of
abatement shall be assessed to the property owner.

Ms. Barbara was present and testified a handicap parking placard was displayed as required.
The vehicle adjacent to her space encroached on the "door swing area"of her space. She parked
to allow room for the door swing, encroaching on the striped area reserved for her parking space.
Deputy Hill represented the County.
Evidence Entered: Exhibit A: 2 photos depicting Ms. Barbara's vehicle encroached on the
striped area.
Deputy Hill testified Florida Statutes prohibit parking in the "striped access" area of a
handicapped parking space. Accordingly a citation was issued.
After hearing the evidence the Special Magistrate GRANTED the Respondent request for
dismissal of the citation.
