HEX Final Decision 2014-06 HEX NO. 2014-06 HEARING EXAMINER DECISION PETITION NO. SV-PL20130002213 —Larry Pronovost of InfiLaw Corporation requests a variance from Section 5.06.04.F.4 of the Land Development Code to increase the number of signs on the American Momentum Building to allow an additional sign on the south face of the building for a total of three signs with a total square footage not to exceed the maximum square footage allowed under Section 5.06.04.F.4 for two signs. The property is located at 8625 Tamiami Trail North, in Section 33, Township 48 South, Range 25 East, Collier County, Florida. DATE OF HEARING: March 13, 2014. STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 5.06.08 B of the Land Development Code has been met and the petition should be approved. ANALYSIS: The petitioner's letter dated October 21, 2013 and included in the staff report stated that the sign being requested would not be illuminated. Consequently, staff included this non-illumination condition in the restrictions provided as part of the staff recommendations for this sign variance. Upon examination of the applicant's detailed drawings that are also part of the staff report, those drawings note that the sign will be "reverse illuminated". The petitioner requested the removal of the staff restriction involving illumination and provided evidence entered into the record, that one of the private reviewing organizations, the Pelican Bay Foundation, had no objection to the removal of this condition and the "reverse illumination" is consistent with the other approved signs for this building. DECISION: Petition SV-PL20130002213, filed by Tim Hancock, AICP of Davidson Engineering, Inc., representing Larry Pronovost of InfiLaw Corporation, with respect to the property described in Exhibit "A", is hereby approved for a variance from Section 5.06.04.F.4 of the Land Development Code to increase the number of wall signs on the American Momentum Building to allow an additional sign on the south face of the building for a total of three signs with a total square footage not to exceed the maximum square footage allowed under Section 5.06.04.F.4.a for two signs, in accordance with the Proposed Site Plan attached as Exhibit "P", and as subject to the conditions set forth below. 1 of 2 ATTACHMENTS: Exhibit A—Legal Description Exhibit P—Proposed Site Plan CONDITIONS: 1. The additional building wall sign is limited to the south façade of the subject American Momentum building. 2. The additional building wall sign may be reverse illuminated channel letters (halo lit). 3. The aggregate square footage of the three signs noted on Exhibit P will not exceed 400 square feet. APPEALS: This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners, Collier County.
