Thanks JOINT STIPULATION OF SETTLIiMENT WHEREAS, Collier County SheriIT Don Hunter, (hereinafter referred to as "SheritT'), has appealed to the Governor and Cabinet sitting as tile Administration Commission the Sheriffs 1998-1999 Fiscal Year }3udget as finally approved by tile Collier County Board of County Commissioners, (hereinafter referred to as "Collier County"); and WHEREAS, the Sheriff, in carrying out his constitutional obligations, prepared and submitted his budget for the Fiscal 1998-1999 Year. Collier County, in approving the Collier County's Fiscal 1998-1999 Year Budget for the SheriIT, established in the County's General Fund an operating reserve in the amount of 5% of tile Sheriffs operating budget, (or approximately S2.9821 Million), as provided by Collier County budget policy, for utilization by the Sheriff as provided in Chapter 30, Florida Statutes; and WHEREAS, due to a dispute between Collier County and the City of' Marco Island, Florida, approximately $1,053,000.00 necessary to cover tile cost of law enforcement within the city limits of the City of Marco lsland ,,,,'as removed from the Sheriff':,', operating budget. This was done by Collier County in anticipation that the City of Marco Island would pay directly to Collier County $1,053,000.00 to cover the cost of tile Shcriff's opera:ions within the city limits of the City of Marco Island; and W}-tEREAS, it became evident to tile Sheriff that tile 5;1,053,000.00 w,mld not be paid bv tile City of Marco Island, therefore requiring the Sheriff to file the budget appeal; and WI-tEREAS. an additional issue resulting in the appeal involved tile accessibility of the Sheriff's reseiw'e for contingencies: and WHEREAS, subsequent to the filing of tile budget appeal, Collier County and tile City of Marco Island resolved tile impasse concerning the transfer of timds for law entbrcemcnt, with the City of Marco Island transfemng approximately 5800,000.00 tbr law enforcement purposes to Collier County. The remaining shortfall in funds for law cnfbrcement within tile city limits of the City of Marco Island can be covered during tile 1998-1999 Fiscal Year out of theSheriff'sreservefunds. Therefore, the issue of tlle shortfail in funds initially in tlle amount of 5;I.053,000 O0 has been fully resolved: and WHEREAS, at a special meeting of the Collier County Board of County Commissioners on June 16. 1999, Collier County approved by a majority of tile Board of County Commissioners that tile Sheriff shall have access to the reserve timds set aside for the benefit of the Sheriff within tile County's General Fund per Florida Statute which provides unresn'icted azcess to that portion of the General Fund Reserve specifically set aside for the Sheriff upon request by a budget amendment; and W}IEREAS, the Sheriff and Collier Counb' have resolved all issues resulting in thc filing o£ the appeal.
