CALL TO ORDER: The meeting was called to order by Chairman Robert Jones at 10:10 AM. A quorum was established; five voting members were present. II. ATTENDANCE: Members: Robert Jones - Chairman Richard Barry, Kenneth Bloom, George Fogg, and Kevin McKyton County: Darryl Richard - MSTU Project Manager Michelle Arnold - Director, Alternative Transportation Modes Dept. Other: Scott Windham - Windham Studio, Inc. (JuriStaff - Anne Iacuzzo) III. APPROVAL OF AGENDA: Richard Barry moved to approve the Agenda as presented. Second by Kevin McKyton. Carried unanimously, 5 - 0. IV. APPROVAL OF MINUTES -March 5,2013: Corrections: • On Page 3 (1St full paragraph) • Following $160,000 - Insert "landscape" • At the end of the sentence, insert "and landscaping of Woodside from Pine Ridge to Forest Lakes Blvd." • On Page 3 (3rd paragraph - 3rd bullet point) o The sentence should read: "Landscape and irrigation of the Woodshire entrance R -O -W areas from Pine Ridge to Forest Lakes Blvd on the west, and from Pine Ridge to the Woodshire pool on the east." • On Page 3, under "A" - Review of Suggested Alternative Plantings • First bullet point - Remove "fairly" • First bullet point- Delete "around" and insert "in front of • Second bullet point - Delete "Crepe" and insert "Asian" April 2, 2013 • On Page 4, under "X" - Public Comments o Second bullet point: The sentences will read: "... the base bid of the new bids will be structured to incorporate the sidewalk, the turn lane, and the lights. The landscaping will become an alternative." Kenneth Bloom moved to approve the Minutes of the March 5, 2013 meeting as amended Second by George Fogg, 5 - 0. V. BUDGET - DARRYL RICHARD A. Proposed Budget - FY 14 (A copy of the proposed Budget was distributed to the members.) Darryl Richard noted the "Forecast" column (middle of page) indicated money forecast to be spent until October 0 and the "FY= 14" contained the monies projected as the Budget for the next Fiscal Year. B. Monthly Budget Report (Report attached: "Forest Lakes MSTU Fund 159, dated April 2, 2013 ") • Current Ad Valorem Tax: • Tax Receipts Received: • To be Collected: • Operating Expense: • Open Purchase Orders: • Spent to date: • Operating Funds Available: • Capital Outlay (available): • Open Commitments: • Spent to Date: • Available (Capital/Improvements): • Reserves (debt service - Bond): • Total Budget: $ 149,900.00 (anticipated) $ 133,949.13 $ 15,950.87 $ 173,500.00 $ 40,040.41 $ 30,460.88 $ 102,998.71 $ 1,138,493.51 $ 58,804.16 $ 67,635.85 ** $ 1,012,053.50 $ 1,166,000.00 $ 2,323,079.10 ( ** - Includes Consultant's fees for Phase I and Phase II Projects) Darryl Richard stated the Budget Office will close out all Purchase Orders at the end of the Fiscal year and re -issue some of the Consultant's Purchase Orders for October 1St Windham Studios, Inc. has three Purchase Orders - some of the encumbered funds will be paid by the end of the Fiscal Year and a new Work Order will be opened for October 1St for the remaining monies owed. Proposed Budget - FY 14 (continued): Darryl Richard explained: • Staff met with the Budget Office to review the current expenditures as well as the expenditures for the remaining portion of this Fiscal year. 2 April 2, 2013 • Line items were examined and a forecast was determined — it is as close as possible to actual expenditures. • The MSTU has the authority to change Line Items 13 through 32. • Many items in the Budget may be removed/adjusted by the Budget Office • The MSTU has no control over certain line items (Lines 36 and transfers to Property Appraiser and Tax Collector) • Line items 34 and 35 are staff costs — analysis has not been completed and the figures may change Mr. Richard requested the Committee review Line Items 13 through 32. • Engineering Fees (Line 13): • Have commitments from Windham Studios for maintenance consulting at $16,179.89 — have paid only $1,500 to date but anticipate spending $12,000 • FY 14 Budgeted amount: $32,000 which includes the other POs with WSI Kenneth Bloom asked if the $16,179.89 would be spent in this Fiscal year. Michele Arnold explained the "Forecast" column is what is anticipated to be spent during the entire Fiscal Year through October. Although $35,000 was budgeted, only $12,000 of will be spent. The "Commitment" item indicates what is open in the Purchase Order. The PO was originally opened for $17,000 anticipating actual construction would take place this year. Since construction has not begun, the expenses anticipated for the PO will be less. The balance on the PO will be returned to be Budget as "carry forward." Kenneth Bloom asked if a surplus would be created and the response was, "Yes." Mr. Bloom: • Budget: $173,500 for the current Fiscal Year (Line 31) • The Budget for Fiscal Year 2014 will be reduced to $143,800 • It is anticipated that the MSTU will collect $148,300 • The MSTU will carrying a surplus of approximately $5,000 into FY 2014 • Continuing to collect $369,200 yearly for Debt Service • Collecting $148,300 for Operations for a total of $517,500 Q. "Is the amount collected for debt service sufficient to pay it ?" A. "Yes." Michelle Arnold stated the Budget Office takes that portion first — the figures for operating and capital indicate what remains after the debt service has been subtracted. Q. "What is Indirect Cost Reimbursement? (Line 15) Is that a County cost ?" A. "Yes." Vice Chairman Fogg asked if the reduced Budget for Fiscal Year 2014 will be enough to cover the new work (Line Item 16). Darryl Richard replied it was anticipated the Budget would be sufficient. He further stated the figures were analyzed regarding what had been spent on maintenance — the bulk of which was allocated for the front entrance. After the sidewalks and lighting April 2, 2013 are installed, the only additional maintenance costs will be replacement of lights (approximately $5,000 per light). Mr. Fogg noted the entrance project will not be completed until the close to the end of the Fiscal Year. He asked if the additional $10,000 would be enough to cover the landscaping incidentals in 2014. Mr. Richard replied, "Yes, it is." Discussion ensued. • New items: plumbing, legal, equipment rental, water and sewer were added as Line Items to the Budget. • "Plumbing" was actually the repairs to the fountains — the Budget Office did not have an option for "fountain maintenance" • Money allocated to Fiscal Year 2015 could be moved around, if necessary and there may be a surplus from other items Kenneth Bloom stated the numbers make sense and look good. George Fogg stated it he hoped the landscaping for Woodshire and Forest Lakes could be finished. Kenneth Bloom moved to approve the draft Budget for Fiscal Year 2014. Second by George Fogg Carried unanimously, S — 0. VI. PROJECT MANAGER'S REPORT — DARRYL RICHARD • Has been working with Commercial Land. The planting have been removed at the front entrance and the Juniper has been installed on half of the circle, as requested • Exceeds F -DOT requirements Richard Barry stated he intended his motion to include the entire circle. Vice Chairman Fogg replied expansion is possible, if necessary. But the job that needed to be done has been done. Michelle Arnold noted the anticipated improvements to the pavers will also increase the sightline. Scott Windham stated visibility will not be an issue as long as the residents abide by the speed limits in the community. Solid double yellow lines will be painted to define the lanes. • The tree stakes will be removed by Commercial Land as well as the "gator" bags. • A letter to the residents is in process concerning the MSTU's maintenance obligations versus their personal responsibilities. A copy of the draft will forwarded the Committee for review before it is sent. VII. LANDSCAPE ARCHITECT'S REPORT — SCOTT WINDHAM, WSI (Report attached: "Status Report, dated April 2, 2013" with map) • Continuing to develop plans for the combined Phase 2 /Phase 3 Project April 2, 2013 • Phase 3 Plan has been completed — includes new turn lane and everything associated with the west entrance • Value engineering of Phase 2 is in process • The scope of work of the Phase 2 Project is being revised (reduced) • When Request for Bids is released, the bids will be within the allocated, available capital Phase 2: • Scope: Completion of the loop, the sidewalk, and the street lighting associated with the sidewalk; the sidewalk will extend to Pine Ridge Road by Publix o The above -items will comprise the `base bid' as directed by the Committee • ABB (civil engineering firm): • Scope: Construct the sidewalk to complete the loop and re-tool the parking on Woodshire • Base Bid: $163,581.29 • TR Transportation: • Scope: Construct lighting required for sidewalk • Base Bid: $511,613.15 WSI and Abney: • Scope: Landscape /Irrigation Construction ( Woodshire entrance area and Forest Lakes connection along Turtle Lakes) • Forest Lakes Blvd: Sod and landscape repair; tree trimming; replacement of boulders • Will run irrigation main line from the Quail Run clubhouse (end of Phase 1) along Forest Lakes Blvd. to the corner of Woodshire and Forest Lakes • Will also run a supply line to irrigate the sign at Woodshire • Woodshire: Planting at east entry sign and associated landscape lighting • Performance Bond, MOT • Base Bid: $149,163 • Phase 2 Base Bid TOTAL: $824,357.44 Phase 3: Entrance Turn Lane • ABB (civil engineering firm): • Scope: Construct turn lane, install traffic signal, refurbish median • Base Bid: $111,552.71 TR Transportation: • Scope: Supply and install lighting • Base Bid: $24,624.95 April 2, 2013 • WSI and Abney: • Scope: Planting and irrigation (removed Ficus will be replaced with "other ") • Base Bid: $ 9,750.00 • Phase 3 Base Bid TOTAL: $ 145,927.66 • Total (combined Projects): $ 970,285.10 • Available Capital: $ 1,012,053.50 • Buffer (Change Orders, etc.) $ 41,768.40 Discussion: • The difference between 2013 and 2014 Budgets is approximately $30,000 and may be added to "Capital/Improvements General" as cushion • Delaying will only increase costs • Items under consideration for future : Install a chain link fence along Publix berm and removal of Bahia grass — only if surplus funds become available • Contingencies will cover unanticipated circumstances, i.e., Issues with Phase 1 — unforeseen underground condition — excessive amount of ledges • Construction was not anticipated to begin this year — Purchasing Department is "behind" — processing of contract may be a problem • Budget is subject to change • Potential commencement: September Comment: "Cannot engineer out everything." Consensus: Consultant was directed to release the Request for Quotes ( "RFQ ") as quickly as possible. VIII. OLD BUSINESS (None) IX. NEW BUSINESS • It was noted there is too much water on the island irrigation should be adjusted. X. PUBLIC COMMENTS Q. "Can you structure the bids to definitely include the sidewalk and lighting ?" A. "The Summary includes all the hard -built items that will be the base bid components." Q. "Does the budget have a `drop dead' date to spend the money or it is lost ?" A. "We have been examining the Operational Budget which is used to run the MSTU. Under this type of budget, a surplus can carry forward to the next Fiscal year." "The Bond issue has a drop dead date for payment — 2021." Q. "Regarding Forest Lakes Blvd., how wide will the sidewalk be?" A. "Five feet wide — the same as Woodshire" "Regarding irrigation at the entrance, there is a possibility that one zone is not capped off." April 2, 2013 A request was made for Darryl Richard to inspect a drainage culvert below the swale at Turtle Lakes — it may have been cut too low. Mr. Richard stated the elevation of swales are determined by the SouthWest Florida Water Management District — it is set and cannot be maintained. Vice Chairman Fogg noted the developers have been known to make mistakes. While it is the responsibility of the MSTU, he suggested Darryl Richard meet with the President of the Turtle Lakes Homeowners Association to inspect the area. Q. "The Purchase Order for electrical repairs for Forest Lakes ...." A. "The initial Purchase Order was sent but has been misplaced. A second will be sent." Some landscaping cannot be done until the electrical has been completed.
