LIST OF REQUESTED DEVIATIONS FROM LDC
TEMPLE CITRUS RPUD
No Section of this PUD shall operate as a deviation to the Land Development Code unless it is expressly
listed in this Exhibit E. No Section of this PUD shall operate as a deviation to the Code of Laws and
Ordinances.
Deviation No. I seeks relief from LDC Section 5.04.04.8.1e, Model }-tomes and Model Sales
Centers, which provides that a temporary use permit for a model home (occupied or unoccupied)
shall be issued initially for a period of three (3) years.
The requested deviation is to allow the model homes to remain in effect up to eight (8) years
without requiring a conditional use.
2. Deviation No. 2 seeks relief from LDC Section 5.04.04.B.5.c, Model Homes and Model Sales
Centers, which provides that a maximum of five (5) models, or a number of corresponding to ten
(10) percent of the total number of platted lots, whichever is less, per platted, approved
development shall be permitted prior to final plat approval as specified above.
The requested deviation provides up to 16 mode( homes and a sales center to be permitted in the
RPUD. Each time the developer applies for a model building permit, lie shall be required to
inform the County how many model homes have been permitted.
3. Deviation No. 3 seeks relief from LDC Section 5.06.02.8.6. and 5.06.02.13.5b. Development
Standards for Signs within Residential Districts, which allows on- premises signs within
residential districts. Two ground signs with a maximum height of 8 feet or wall, residential
entrance or gate signs with a maximum height of 8 feet may be located at each entrance to multi-
family or single - family development.
The requested deviation is for two (2) entrance signs as depicted in Exhibit C-I A to be allowed a
maximum of 10 feet in height adjacent to Livingston Road right -of -way. See Deviation No. 413
for copy area) (See Exhibit C -I A for sign details).
4. Deviation No. 4A seeks relief from LDC. Section 5.06.02.B.6.b, Development Standards for
Signs within Residential Districts, which allows two ground signs at each entrance to a multi-
family or single family development.
The requested deviation is to allow two entrance or gate signs on the recreation area depicted on
the RPUD Master Plan, and as shown on Exhibit C -1A.
Deviation No. 4D seeks relief from LDC Section 5.06.02.B.6.b, Development Standards for
Signs within Residential District, which allows the ground or wall sign not to exceed a combined
area of 64 square feet and shall not exceed the height and length of the wall or gate upon evhich it
is located.

The requested deviation is to allow the two project entrance signs on Livingston Road with a
maximum area of 64 square feet per side and a total area of 128 square feet (both sides). (See
Exhibit C -4-1A for sign details). The recreation area signage shall not exceed a combined area of
64 square feet and shall not exceed the height and length of the wall or gate upon which it is
located.
5. Deviation No. 5 seeks relief from LDC Section 5.06.02.B.5.b, Development Standards for Signs
within Residential District, which allows directional signs to be combined into one sign with a
maximum height of 8 feet and a maximum area of 24 square feet.
The requested deviation is to allow for no limitation on the number of combined signs provided
they are separated by a minimum distance of 100 feet or a road right -of -way. The directional
signs are subject to the maximum height of 8 feet and maximum area of 24 square feet.
6. Deviation No. 6 seeks relief from LDC Section 5.06.02.B.5.a, Development Standards for Signs
within Residential District, which allows on prernise directional signs be set back a minimum of
10 feet from the edge of the roadway, paved surface or back of the curb, as applicable.
The requested deviation is to allow the directional sign to be located five feet from a roadway or
platted easement, excluding public roadways, if it does not result in public safety concerns or
obscure visibility of the motoring traffic, as determined by the County Manager or designee.
7. Deviation No. 7 seeks relief from LDC Section 5.04.06.A.3.e, Temporary Signs, which requires
that temporary signs on residentially zoned properties shall not exceed 34 square feet in area in
sign area.
The requested deviation is to allow temporary signs and banners to be 48 square feet in area.
8. Deviation No. 8 seeks relief from LDC Section 6.06.01.0 and Appendix B which require cul de
sacs and local streets to have a minimum 60- foot -wide right -of -way.
The requested deviation is to allow both 40- foot -wide and 50- foot -wide right -of -way widths for
internal streets (See also Exhibit C -2).
9. Deviation No. 9 seeks relief from LDC Section 6.06.02.A.1, Sidewalks, Bike Lane and Pathway
Requirements, which requires sidewalks on both sides of a local street that is adjacent to the site.
(See Exhibit C -4 The Side -walk Plan).
The requested deviation is to allow a sidewalk five feet in width on just one side of the street for
local roadways 40 feet in width (see also Exhibit C -2, and Exhibit C -4 The Side -walk Plan).
10. Deviation No. 10 seeks relief from LDC Section 4.07.02.F., Off Street Parking for Planned Unit
Developments which requires that off - street parking requirements shall be as for comparable
type, density, and intensity of uses established in the PUD.
The requested deviation is to allow the recreational facilities to provide parking at 75% of the
normal LDC requirements.

DEVELOPER COMMITMENTS
TEMPLE CITRUS RPUD
1. TRANSPORTATION
A. The developer(s), its successor(s) in title, or assignee(s), shall be responsible for
the cost of a traffic signal at the main development entrance on Livingston Road
located within the Temple Citrus RPUD when determined warranted and
approved by Collier County Transportation Staff. Contingent upon the completed
installation, inspection, burn-in period, and final approval the traffic signal (as
defined by the applicable Developer Contribution Agreement), said traffic signal
shall be conveyed to Collier County for ownership and maintenance. If a traffic
signal is not warranted, as determined by Collier County Transportation's staff,
the developer's obligation for the traffic signal shall end upon the issuance of the
final certificate of occupancy submitted by the developer, his successor, or assign.
B. The development within this project shall be limited to 457 unadjusted two-way
PM peak hour trips; corresponding to the trip generation calculations within the
Traffic Impact Study with a revision date of June 12, 2013 allowing for flexibility
in the proposed uses without creating unforeseen impacts on the adjacent roadway
network. For the purposes of calculation of the weekday PM peak hour trip
generation in this PUD, the lesser of the weekday PM peak hour trips as
calculated in the Institute of Traffic Engineer's (ITE) Report, titled Trip
Generation, 9"' Edition or the trip generation as calculated in the then current ITE
Trip Generation Report shall be utilized.
C. A mass transit easement shall be dedicated to Collier County by the property
owner at no cost to Collier County prior to the issuance of the first Certificate of
Occupancy. The size of the mass transit easement shall be 20 feet by 10 feet.
2. UTILITIES
A. The developer, its assigns or successors may apply to the County for the use of
treated sewage effluent within the project limits for irrigation purposes, subject to
availability. The developer at its sole cost shall be responsible for providing all
on-site piping and pumping facilities from the County's point of delivery to the
project and may provide full or partial on-site storage facilities, as required by the
Florida Department of Environmental Protection, consistent with the volume of
treated wastewater to be utilized and subject to availability of treated effluent.
B. Stubs for future system interconnection with adjacent properties shall be provided
to the north side of the recreation parcel of the project and to Manchester Square
to possibly avoid Livingston Road connection. The precise locations of these

interconnections shall be mutually agreed to by the Utilities Division and the
Developer during the design phase of the project.
3. ENVIRONMENTAL
A. No preserve area shall be required for this RPUD.
4. REMOVAL OF CITRUS STORE AND ACCESS TO CITRUS STORE SITE
A. The Gitfus Stef-ecommercial use on Airport Pulling Road shall be closed prior to
the issuance of Certificates of Occupancy for 75% of the residential units within
the Temple Citrus RPUD.
5. PUD MONITORING
A. One entity (hereinafter the Managing Entity) shall be responsible for PUD
monitoring until close-out of the PUD, and this entity shall also be responsible for
satisfying all PUD commitments until close-out of the PUD. At the time of this
PUD approval, the Managing Entity is Naples Associates V, LLLP. Should the
Managing Entity desire to transfer, the monitoring and commitments to a
successor entity, then it must provide a copy of a legally binding document that
needs to be approved for legal sufficiency by the County Attorney. After such
approval, the Managing Entity will be released of its obligations upon written
approval of the transfer by County staff, and the successor entity shall become the
Managing Entity. As Owner and Developer sell off tracts, with the exception of
individual residential lots, the Managing Entity shall provide written notice to
County that includes an acknowledgement of the commitments required by the
PUD by the new owner and the new owner's agreement to comply with the
Commitments through the Managing Entity, but the Managing Entity shall not be
relieved of its responsibility under this Section. When the PUD is closed-out,
then the Managing Entity is no longer responsible for the monitoring and
fulfillment of PUD commitments.
6. SCHOOL ACCESS
A. A pedestrian access to Osceola Trail shall be provided along the southern
boundary of the project as depicted on the RPUD Master Plan and shall be a
minimum of 8 feet in width.
B. The recreation site depicted on the RPUD Master Plan shall be designed to
facilitate the turning movements for school buses.

TEMPLE CITRUS GROVE RPUD
1. Deviation No. 1 seeks relief from LDC Section 5.04.04.B.3. e, ModellHonmes and Model
Sales Centers, wench provides that a temporary use permit,(or° a model home (occupied
or unoccupied) shall be issued initially for a period of three (3) years.
The requested deviation is to allow the model homes to remain in effect up to eight (S)
years without requiring a conditional use.
The justification for this deviation is that Temple Citrus Grove RPUD is a ±I32 acre
project with 512 dwelling units. Depending on market conditions it may take longer than
three years to build out. GL Homes experience with other Naples area projects ( "Saturnia
Lakes aka Rigas PUD ", "Riverstone aka Terafina PUD" and "Marbella Lakes aka
Livingston Village PUD ") is that model homes should remain in operation until the
project is nearing build out without requiring a Conditional use.
Deviation No. 2 seeks relief from LDC'Section 3e 04 <04.B.5.c, Model Flomaes and Model
Sales Centers, which provides that a maximum of five (5) models, or a number o
corresponding to ten (10) percent of the total number of platted lots, whichever is less,
per platted, approved development shall he permitted prior to final plat approval as
specified move,
The requested deviation provides up to 116 model homes and a sales center to he
permitted in the RPUD. Each time the developer applies.for a model building permit,
he shall be required to inform the County how naaray model homes are in operation.
The justification for allowing up to 16 model homes and a Sales Center to be permitted in
the Temple Citrus Grove RPUD is based on the size of the project and the developer's
experience with marketing other projects it, Collier County (noted above). A similar
deviation was approved for "The Parklands DRI /PUD" project (up to 16 model homes
permitted) and "Saturnia Lakes" (up to 12 model homes permitted), also owned by
affiliated entities of GL Homes. This number of model homes internal to the project will
not contravene the public health, safety, and welfare.

3 Deviation No. 3 seeks relief from, LDC Section 5.06.02.R.6. and 5.06.02.B.I.a
Development Standards for Signs within Residential Districts which allows on-

home or recreational vehicle park.
The requested deviation is to allow two (2) entrance signs on Livingston Road (See
Exhibit C -IA). These signs will be a maximurn I0 feet in height. See Deviation No.

The justification for this deviation is to enhance the exposure of the RPUD along
Livingston Road, an arterial roadway, as a convenience to the motoring public, with two
(2) additional feet of height for the proposed signage. A similar deviation was approved
for "The Parklands DRI /PUD" recently and for "Saturnia Lakes ", also owned by
affiliated entities of GL Homes located along the Logan Blvd. extension, north of
Immokalee Road. Approval of this deviation will not contravene the public health,
safety, and welfare.
4. Deviation Nail. 4A seeks relief to section 5.06, 006 on premises, signs within residential
districts by allowing two entrance or gate signs at each entrance. The deviation is to
allow signage in the recreation area depicted on the RPUD Master plan, similar to that
permitted at the project's entrance that are two signs 32 square feet in area or one sign
64 square feet in area.
The justification for this deviation, for the signage in the recreational area is that it is a
convenience to the project residents and visitors. Furthermore, the Land Development
Code does not provide for a sufficient size of signs for Recreational Areas. For example:
Identification Signs are limited to a size of 8 square feet and do not adequately provide
,for sufficient size of signage to community gathering areas. The signage by the
recreational area is internal to the subject property with NO impact on surrounding
properties beyond the perimeter of the subject property.
Deviation No. 4B seeks relief from LDC Section 5.06.02.R.6.b, Development
Standards for Signs within Residential District, which allows the groused or wall sign
not to exceed a combined area of 64 square feet and shall not exceed the height and
length of'the wall or gate upon which it is located
The requested deviation is to allow the two project entrance signs with a maximum
area of 64 square feet per side and a total area of 128 square feet (both sides) on

The justification.for this deviation along the ± 1,050 feet of frontage on Livingston Road
is to enhance the exposure to the project entrance as a convenience to the motoring
public.
Further justification for this deviation is that the FPL easement 275 feet in width serves
to diminish the visibility of the proposed entrance signage.
The 45 miles per hour speed limit on Livingston Road also supports the deviation.for
somewhat larger signage. (See also Exhibit C -]A, for details.)
5. Deviation No. 5 seeks relief from :L,DC Section 5.06.02,B.5.b, Development Standards
for Signs within Residential District, which allows directional signs to be comdbined
into one sign with a maximum height of 8 feet and a ,maximum area of 24 square feet.
The requested deviation is to allow ,for no limitation on the number of combined signs
provided they are separated by a minimum distance of 100 feet or a road rightmof way.
The justification for this deviation is that this Temple Citrus Grove RPUD will comprise
a number of neighborhoods separated by lakes and open space areas that merit a larger
number of directional signs, as a convenience to the motoring public. The separation in
the distance between directional signs of a minimum of 100 feet will minimize any
negligible impacts. Approval of this deviation will not contravene the public health,
safety, and welfare.
6. ][Deviation No. 6 seeps relief from LDS° Section 5.06.02.B.5.a, Development Standards
for Signs within Residential District, which allows on premise directional signs be set
back a minimum of 10 feet from the edge of the roadway, paved surface or back of the
curb, as applicable.
The requested deviation is to allow the directional sign to be located five feet from a
roadway or platted easement, excluding public roadways, ff it does not result in public
safety concerns or obscure visibility of the :motoring traffic.
The justification for this deviation is a convenience to the motoring public, by placing the
directional sign to be located closer to the traveled roadway. Approval of this deviation
will not contravene the public health, safety, and welfare; if no, public safety or obscured
visibility will result.
7. Deviation No._ 7 seeks relief from IL,DC Section 5004006 A3. d, Temporary Signs, which
requires that temporarw signs shall not exceed 32 square feet in area in sign area.
The requested deviation is to allow temporary signs and banners to he 48 square feet inn

The justification for this deviation is based on the developer's marketing experience that
a somewhat larger sign is more visible from an arterial roadway, as a convenience to the
motoring public based on the project size, speed limit, and location on Livingston Road.
A similar deviation was approved for "The Parklands DRI /PUD" recently, also owned by
an affiliated entity of G.L. Homes on the Logan Blvd.
8. Deviation No. 4 seeks relief from LDC Section 6.06.01.0 and Appendix P which
require cul de- sacs and local streets to have a minimum 60 fbot -wide right-of-way.
The requested deviation is to allow both 40-foot-wide and 50-foot-wide right- of-way
widths for internal streets (See also Exhibit C'-2).
The justification for this deviation is that the local streets can be readily accommodated
with this right-of-way width as demonstrated by the cross section provided for in Exhibit
C -I A similar deviation was approved for "The Parklands DRI /PUD" recently, also
owned by an affiliated entity of GL Homes on the Logan Blvd. Approval of this
deviation will not contravene the public health, safety, and welfare.
9. Deviation No. 9 seeks relief from LDC Section 6.06.02.A.1, Sidewalks, Bike Lane and
Pathway Requirements, which requires sidewalks on both sides of a local street that is
adjacent to the site.
The requested deviation is to allow a sidewalk five feet in width on just one side of the
street for local roadways 40 feet in width (see also Exhibit C=2).
The justification for this deviation is that the RPUD will include ample open space in
excess of that required by the LDC that is 60 % sixty percent is proposed and 63 % sixty
three percent open space is now proposed in this RPUD. Some common areas will
facilitate the movement of pedestrians within the master planned community including
the recreation area. However, some of the lake common areas will only provide access
to individual neighborhoods within the RPUD. In addition, most (but not all) of the 40
foot rights of way are single loaded roadways (houses located on only one side of the
street) and the sidewalk is proposed to be located on the residential unit side of the street.
Most (but not all) of the residential units located on 40 foot rights -of -way, therefore, will
have a sidewalk on the house side of the street. For the few double loaded roadways
(houses located on both sides of the street), a sidewalk will be located on the other side of
the street in close proximity to those few residential units.

10. Deviation No. 10 seeks relief from LDC Section 4.07 02.E Off Street Parking for
Planners Unit Developments which requires that off-street parking requirements shall
be as for comparable type, density and intensity of uses established in the PUD.
The requested deviation is to allow the recreational facilities and community
center /Club house to provide parking at 75% of the normal LDC requirements.
The justification for this deviation is that the proposed DPD is a master planned
community that includes ample open space areas and controlled access that is pedestrian
friendly; therefore, the community is conducive to walking and bicycling. In addition, the
recreation area is centrally located within the development area, thereby reducing the
associated travel distance from the residential units to the recreational amenities.
Furthermore, a reduction in parking spaces will reduce impermeable surface. It will also
not contravene the public health, safety, or welfare.
Approval of this deviation will not contravene the public health, safety, and welfare.
11. Deviation No. 11 seeks relief from LDC Section 4.06.02. C2. Buffering requirements
requires a Type 8 buffer 1 S foot wide for residential uses adjacent to commercial uses.
The required deviation is to reduce the type P buffer from 15 to 10 feet. The buffer will
include a wall and provide for the same number of plantings typically contained in a
Type D Buffer along a portion of the North side of the property adjacent to the Willow
Park commercial PUD, and the Lone Oak PUD. (See Exhibit C®1 RPUD Master Plan)
The justification for this deviation is that the anticipated duplex lots on a portion of the
North property line adjacent to the "Willow Park" Commercial PULE, will only be located
on the South side of the local access road that will benefit from additional separation
from the Willow Park PUD by the width of the right -of -way. The balance of the North
property line at this location to the recreational area to the East will continue the 10 foot
wide type B buffer with a wall that abuts multi - family uses in the residential component
of the bone Oak PUD, making the width of this buffer of a similar width along this
portion of the property line.
It should be noted that the multi - family uses north of the Temple Citrus Grove RPUD at
this location in the bone Oaks PUD include a buffer and a local street with units located
on the North side of the local road, creating a separation of an additional ± 50 feet.
Deducing the buffer by 5 feet in width will have a negligible impact between the two
PUD's based on existing conditions. In addition the same number of plantings will be
contained in the modified type B buffer. (See also Exhibit C -3 Landscape Buffer Cross
Section).
