Peter Flood, Attorney for the Respondent was present.
Mr. Flood reported the order entered did not indicate he was present at the hearing.
Additionally, a copy of the order was not provided to him via US mail and he ascertained a copy
subsequent to his meeting held October 7, 2013 on site with County Officials.
When he met on site with County Officials, they indicated progress on site was satisfactory and
he believed, based on the conversations, the abatement was completed in accordance with the
emergency hearing held on October 4, 2013.
After obtaining a copy of the order, it came to his attention the County required issuance of a
Boarding Certificate. The order does not reflect what was agreed upon by staff and the
Respondent at the October 4, 2013 hearing regarding obtaining a Boarding Certificate, where
County Officials indicated it would not be required.
Jeff Wright, Director, Code Enforcement sought clarification if a re-hearing is being
requested as the grounds for a re-hearing have not been established.
Discussion occurred between Mr. Wright, Mr. Flood and the Special Magistrate on the format of
the today's hearing (Motion to Amend a Previously Issued Order vs. a Motion for a re-hearing).

The Special Magistrate stated, and Mr. Flood agreed the request is to Amend a Previously
Issued Order.
Mr. Wright requested the video or audio of the meeting and/or a verbatim written transcript be
entered as evidence to determine if the order reflects the events that transpired at the October 4,

Mr. Flood agreed.
The Special Magistrate determined to review the audio file from the matter before her on
October 4, 2013 to determine if the Order should be amended. The case was continued until

was unaware the white striped area was an access area and restricted from vehicles from
parking.

depicts a white striped area.
After hearing the evidence the Special Magistrate DENIED the Respondent request for

and$5.00 Administrative Fee for a total amount due of$305.00

Mr. Ramos testified:
• He resides in Lee County and had placed an advertisement on craigslist to provide
transportation.
• He was contacted by the Investigators to provide transportation as part of a"sting"
operation.
• He does not have a business and has never transported clients prior to this event.
• He was contacted numerous times by the Investigators who urged him to provide the
service.
• He appeared at the scene, no service was provided and felt he was "entrapped" as, if
there had not been numerous requests by Investigators to fulfill the service, he would
not have appeared at the scene.
Investigator Short reported the County has been made aware by vendors legally providing
service of an ongoing issue of persons operating vehicles for hire without the proper licensing.
He agreed the County did initiate the contact and Mr. Ramos was cooperative at the scene.
After hearing the testimony, the Special Magistrate found the Respondent NOT GUILTY of
Operating a Vehicle for Hire without the proper licensing.

Carlton C. Graham was present and testified:
• He formerly operated a Vehicle for Hire business, but it has been out of service for over
3 years.

• He was contacted via phone repeatedly to provide transportation service from Naples
Airport (unbeknownst to him, by the County in coordination with a"sting"program).
• During the contacts, he repeatedly informed the caller he no longer provided the service,
however would try to find another party to fulfill the service. He informed the caller the
fee for the service requested is generally $45.00.
• When additional messages were left for him regarding providing service, he returned the
phone calls to notify the person he no longer provided the service, however the calls
went unanswered.
• He maintains an office at the Naples Airport, and finally, he met the person who was
contacting him for service, to notify them in person he no longer provided the service
and to cease contacting him.
Investigator Musse testified:
• The "sting" operation was conducted as the County received complaints unauthorized
Vehicle for Hire services were being operated.
• Research indicates Mr. Graham's Vehicle for Hire license expired on 2/26/11.
• The County contacted Mr. Graham for provision of service for 9/23/13 and agreed upon
a fee.
• When Mr. Graham arrived on scene, Investigator Lopez, posing as a potential client,
verified the cost of the service.
• Following the on site contact with the Mr. Graham, a citation was issued for Operating a
Vehicle for Hire without the proper licensing.
Mr. Graham objected that Investigator Lopez was not present to provide testimony. He never
received any money nor provided any services to the Investigator, therefore was not operating a
Vehicle for Hire service.
Investigator Snow reported, the County based the issuance of a citation on the fact Mr.
Graham quoted a fee for the service, arrived at the scene and verified the price of the service
with Mr. Short. The activity meets the definition of"operating" a Vehicle for Hire Service.
The County has no objection to calling Mr. Lopez as a witness at a later date.
The Special Magistrate CONTINUED the hearing,pending an appearance by Mr. Lopez.

• The family has resides on the property and the buildings were constructed many years
ago.

• They are attempting to abate the violation by slowly dismantling any unwanted
structures and disposing of the debris.
• They are contacting engineering consultants to determine the necessary measures
required to permit the structures intended to remain on site.
• They requested more time to abate the violation.
Finding the Notice of Hearing was properly served, the Special Magistrate found the
Respondent GUILTY of the alleged violation and ordered to:
1. Pay Operational Costs in the amount of$112.29 incurred in the prosecution of the case
by March 15, 2014.
2. Abate all violations by obtaining all required Collier County Building Permit(s), or
Collier County Demolition Permit(s) and required inspections and Certificate of
Occupancy/Completion by March 15, 2014 or a fine of$50.00 per day will be imposed
until the violation has been abated thereafter unless altered by a subsequent Stipulation
or der of the Special Magistrate.
3. Notify Code Enforcement within 24 hours of abatement of the violation and request the
Investigator perform a site inspection to confirm compliance 24 hours. Notice shall be by
phone and made during the work week. If the violation is abated 24 hours prior to a
Saturday, Sunday or legal holiday, then the notification must be made on the next day
that is not a Saturday, Sunday or legal holiday.
4. If the Respondent fails to abate the violation the County may abate the violation and may
use the assistance of the Collier County Sheriffs Office to enforce the provisions of the
Order and all costs of abatement shall be assessed to the property owner.
