THIS IS NOT HOMESTEAD PROPERTY. TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter upon said land, excavate, and place or remove materials, including, but not limited to wastewater lines and pipes, and other below ground equipment or improvements appurtenant thereto or thereunder for the purpose of constructing, operating, and maintaining wastewater utility facilities thereon. Grantee shall not install wastewater utility facilities or perform routine maintenance within the easement area from November 1st through April 30th during such time the Grantor is actively selling real estate in the Esplanade Golf and County of Naples. Grantee shall notify Grantor or its assigns 30 days prior to initiating an , installation or routine maintenance activities within the easement area. There shall be no above ground equipment or facilities located in the easement area. The easement granted herein shall constitute an easement running with the land and shall burden the lands described above. GRANTOR RESERVES THE RIGHT to install and maintain landscape and other improvements within the easement area without restrictions. Any damage to or disturbance of Grantor's improvements in any way by Grantee shall be immediately restored or replaced by Grantee to a condition acceptable to Grantor.
