(Exhibit `B" attached hereto is a sketch or other graphic representation that depicts the physical location of the utility systems being conveyed.) and said Grantor does hereby fully warrant the title to said utility facilities and/or system(s) or portion(s) thereof, be they realty, personally, or mixed, and Grantor will defend such title against all claims of all persons whomsoever. For the purposes of this conveyance, the utility facilities, system(s) and/or portion(s) thereof conveyed herein shall not be deemed to convey any of the lands described in either exhibit, Grantor and Grantee are used for singular or plural, as context allows. A sketch or other graphic representation showing the location of the utility facilities, etc., being conveyed is attached as Exhibit B. TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with the right to enter upon said land, excavate, relocate and/or take or introduce materials for the purpose of constructing, relocating, operating, repairing and/or, otherwise maintaining utility systems thereon. OBJECTIVE: To obtain authorization for the Chairman of the Collier County Board of County Commissioners to execute the Utility Facilities Warranty Deed and Bill of Sale. CONSIDERATION: The Board of County Commissioners, as the owner of Folio #00399360008 which is the location of the Collier Area Transit Administration and Operations Center, recently completed construction of a sewer line and connection to the Collier County Water -Sewer District sewer system on Davis Boulevard at CAT. As part of the permitting process for the sewer with the Collier County Engineering and Environmental Services Department, a Utility Facilities Warranty Deed and Bill of Sale must be submitted whenever turning maintenance and ownership of any utility over to the Collier County Water -Sewer District. This document requires execution by the owner. Only the segment of sewer line that lies within the Right -of -Way on Davis Boulevard is to be maintained and owned by Collier County Water -Sewer District. The sewer system that is located within Folio #0399360008 will continue to be owned and operated by Collier County Board of County Commissioners. FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact. However, approval of the Executive Summary will result in the Collier County Water -Sewer District receiving unconditional title to the utility facility within the right -of -way, which at the time of preliminary acceptance has a total (undepreciated) value of $3,684.00. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATION: The Utility Facilities Warranty Deed and Bill of Sale has been reviewed and approved for legal sufficiency by the County Attorney's Office. — JAB RECOMMENDATION: That the Board of County Commissioners authorizes the Chairman to execute the Utility Facilities Warranty Deed and Bill of Sale.
