HEARING EXAMINER DECISION
PETITION NO. VA- PL20130000745 — Banyan Woods Homeowner's Association, Inc. and
Gary A. Godley are requesting a variance from Section 5.03.02.0 of the Land Development
Code to replace two of the existing perimeter privacy walls with two new privacy walls up
to ten feet in height within the residential component of the Meadowbrook Planned Unit
Development. The subject property is located east of Airport Road and south of Pine Ridge
Road in Section 13, Township 49 South, Range 25 East, Collier County, Florida.
DATE OF HEARING: January 23, 2014
STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant and the public,
and the recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in
Section 9.04.03 of the Land Development Code has been met and the petition should be
approved.
ANALYSIS:
The Banyan Woods subdivision is a residential project adjacent to Activity Center #13.
Businesses within this activity center are allowed to operate on a 24 -hour basis. The developed
land elevations of the commercial tract within the Activity Center adjacent to Banyan Woods
have height differences of four feet compared to the developed land elevations at Banyan
Woods. To reduce incompatible activities generated by this close proximity to commercial uses,
the applicant's request to increase the allowed wall height an additional four feet above the
allowed six feet is warranted for the reasons as outlined in the staff report.
DECISION:
The Hearing Examiner hereby approves Petition No. VA- PL20130000745 filed by Jeffrey A.
Nunner, PE, of Nunner, LLC, representing Gary A. Godley and Banyan Woods Homeowners
Association, Inc., for a variance from the 6 foot height limit in LDC Section 5.03.02.0 to allow
the replacement of two of the existing perimeter privacy walls with new walls up to ten feet in
height in the Meadowbrook Planned Unit Development zoning district, as shown in the
Conceptual Site Plan attached as Exhibit "A ".

APPEALS:
This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013 -25, as

Examiner Decision is rendered.
