A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA DENYING A PETITION TO DISCLAIM,
RENOUNCE AND VACATE THE COUNTY AND THE PUBLIC INTEREST
IN A PORTION OF MAMIE STREET SOUTH OF CHOKOLOSKEE
DRIVE, BEING A PART OF SECTION 36, TOWNSHIP 53 SOUTH, RANGE
29 EAST, CHOKOLOSKEE, COLLIER COUNTY, FLORIDA.
WHEREAS, pursuant to Section 336.09, Florida Statutes, and Resolution 2006 -160,
Petitioner, COLLIER COUNTY, FLORIDA, has requested the vacation of the County and the
public interest in a portion of Mamie Street as shown on Exhibit "A," being a part of Section 36,
Township 53 South, Range 29 East, Chokoloskee, Collier County, Florida; and
WHEREAS, at its September 10, 2013 regular meeting, the Board of County
Commissioners, via Resolution No. 2013 -167, approved the scheduling of a public hearing
pursuant to Resolution 2006 -160 on October 22, 2013 and further continued the public hearing to
January 14, 2014; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the Petitioner's request and notice of said public hearing was given as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
For the reasons set forth in the record, the County's request to vacate, extinguish,
renounce and disclaim the County's and public's interest in a portion of Mamie Street as shown
on Exhibit "A," being a part of Section 36, Township 53 South, Range 29 East, Chokoloskee,
Collier County, Florida, is hereby DENIED. The Board finds that there was competent and
substantial evidence to arrive at this decision.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring same,
this 14`h day of January, 2014.

Description of part of Section 36, Township 53 South, Range 29 East, Collier County, Florida.
(Proposed Roadway Easement over a portion of existing paved Mamie Street,
Chokoloskee, Florida.)
All that part of Section 36, Township 53 South, Range 29 East, Collier County, Florida, being
more particularly described as follows;
Commencing at the east 'i4 corner of said Section 36;
Thence on an assumed bearing of N. 00'12'14" E., along the east line of said Section 36, also
being the centerline of Smallwood Drive (50' ROW), a distance of 577.74 feet to the centerline
of Chokoloskee Drive (50' ROW);
Thence N. 84 °57'50" W. along the centerline of said Chokoloskee Drive, a distance of 169.01
feet to an angle point in said centerline;
Thence N. 76 °02'51" W. along said centerline, a distance of 408.84 feet to an angle point in said
centerline;
Thence leaving said centerline, S. 23 °34'59" W., a distance of 28.55 feet to a point on the south
right -of -way line of said Chokoloskee Drive;
Thence along said right -of -way line S. 84 °52'07" W. a distance of 231.34 feet to the Point of
Beginning of the hereinafter described easement, being 17 feet in width more or less and
overlaying the existing paved Mamie Street;
Thence leaving said south right -of -way line of Chokoloskee Drive S. 21 °25'22" W. a
distance of 139.12 feet;
Thence S. 25° 12'21" W. a distance of 43.07 feet to the beginning of a circular curve concave
to the east and having a central angle of 33 °52'01 ", a radius of 210.04 feet, an are length of
124.15 feet, a chord of 122.35 feet and a chord bearing of S. 173017" W. to the end of said
curve;
Thence S. 01'39'47" E. a distance of 248.59 feet;
Thence S. 06 °01'42" W. a distance of 63.42 feet;
Thence S. 02 °23'49" W. a distance of 84.43 teet to a point on the west line of lot 12,
Smallwood's Division, as recorded in Plat Hook 1; page 27 of the Public Records of Collier
County, Florida;
Thence along said west line of lot 12, S. 28 °11'20" W. a distance of 39.07 feet;
Thence leaving said west line of lot 12, N. 02 °23149" E. a distance of 120.15 feet;
Thence N. 06 °01'42" E. a distance of 62.82 feet;

the end of said curve;
Thence N. 25 °12'21" E. a distance of 41.17 feet;
Thence N. 21 °25'22" E. a distance of 130.06 feet to the south right -of -way line of
Chokoloskee Drive;
Thence along said south right -of -way line, N. 84 °52'07" E., a distance of 19.00 feet to the
Point of Beginning of the easement herein described.
