Resolution 1994-694I I t� a �o cull TO M SOLD ucoUro in Lot offrauRucous of a n comet, >, uc ne tus.oe MIMICS 9T1 MO! 09/22/94 at 03:1911 DTIG1T f. 310a, Cull RY 140s SEP 2 01994 RESOLUTION NO. 94 -694 RESOLUTION AUTHORIZING RECORDING OF NOTICES OF DELINQUENT SPECIAL ASSESSMENTS FOR SOLID WASTE COLLECTION AND DISPOSAL SERVICE CHARGES PURSUANT TO COLLIER COUNTY ORDINANCE NO. 90 -30, AS AMENDED, AND DIRECTING THAT WRITTEN NOTICES OF SUCH RECORDATION OF LIENS BE MAILED TO THE AFFECTED RESIDENTIAL UNIT OWNERS. WHEREAS, Section Twelve of Collier County Ordinance No. 90 -30, as amended, requires that the Board of County Commissioners, by Resolution, record notices of delinquent special assessments for solid waste collection and disposal service for certain real properties in Solid Waste District No. 1 or Solid Waste District No. 2 in unincorporated Collier County; and WHEREAS, the Resolution to record is to be approved after the Tax Collector (or other Board designee) delivers to the Board a list of outstanding and delinquent special assessments; and WHEREAS, said list of Outstanding and delinquent special assessments has been received by the Board from the Tax Collector through the Clerk Flrsuant to an Agreement between the Tax Collector and the Board; and WHEREAS, in accordance with Section Twelve of Collier County Ordinance No. 90 -30, as amended, the list specifies the outstanding amount of the respective delinquent special assessments including interest accrued thereon at the rate of twelve percent (12 %) per annum, a legal description of the residential units against which the respective liens shall be imposed, and the names of the owner(s) of each respective residential unit as currently indicated on the Property Appraiser's Assessment Roll, even though said Assessment Roll may not in every case be current regarding owners ;hip information; and WHEREAS, the list of delinquent assessments shall be recorded in the public record of Collier County. Any property showing a delinquent sum of legs than $5.00 shall not constitute a lien subject to a foreclosure action and judicial sale under the Resolution because the administrative costs of enforcement by foreclosure outweigh the public benefit of pursuing such 1 5001 1.0 PAS[ 143' OR: 1987 PG: 1515 SEP 1 0 1994 proceedings. A written notice of the imposition of each lien of $5.00 or more on each residential unit listed thereon must be mailed by the Clerk to each owner of the such residential unit as shown on Exhibit "A" addressed to the unit owner's last known mailing address, as required by Section Twelve of Collier County Ordinance 90 -30, as amended. NOW, THEREFORF, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The Clerk to the Board of County Commissioners is hereby directed to record in the Official Records of Collier County this Resolution, a map of Solid Waste Districts No. 1 and No. 2 and the list of the 1993 delinquent solid waste collection and disposal service special assessments, attached hereto as "Exhibit A" and made a part of hereof. 2. The Clerk is hereby directed to mail to each residential unit owner as the owner's name and last known address are shown on the attached Exhibit "A ", a written notice of recording of that respective owner's delinquent special assessment lien for 1993. No notice shall be mailed if the total sum due is leas than $5.00. Each notice to be mailed shall be in substantially the following form: BOARD OF COUNTY COMMISSIONERS COLLIER COUNTY, FLORIDA LEGAL NOTICE 01' ASSESSMENT OF LIEN ACCOUNT NO. LEGAL DESCRIPTION: DATE: The owner(s) of record of the real property described above have been mailed a notice of a Solid Waste Collection and Disposal Service Special Assessment by the Tax Collector of Colliez County. That notice specified that the above property tas assessed for the 1993 solid waste collection and disposal service special assessment. According to our records the money assessed has not been paid. By Resolution of the Board of County Commissioners 2 BOOK (l0 m,,444 OR, 1907 roc 1516 SEP 2 0 1994 of Collier County, Florida, a Notice of Delinquent Lien against the above described real property was recorded on , 19—, in Official Record Book, Pages of the Official Records of Collier County, Florida, showing an assessment of $ plus then accrued interest thereon at 12 per cent per year in the amount of $ , for a total sum of $ which is past due and delinquent. The above real property shall become subject to foreclosure and judicial sale to satisfy this delinquent lien unless the lien and all accrued interest thereon are paid in full. If a lawsuit is filed, the lien will then incur substantial additional costs and attorney's fees. You must contact the Collier County Finance Department and pay the delinquent lien in full, including all interest.
