Greene, Assistant County Attorne ( ()— DATE: March 18, 2010 RE: Sunshine Law and Agenda question The issue presented is whether the Sunshine Law requires that an agenda be made available prior to board meetings. In summary,the answer is no. The Sunshine Law Manual (2009 Ed. Vol. 31)provides the following: The Attorney General's Office recommends publication of an agenda, if available, in the notice of the meeting;. if an agenda is not available, subject matter summations might be used. However, the courts have held that the Sunshine Law does not mandate that an agency provide notice of each item to be discussed via a published agenda. Such a specific requirement has been rejected because it could effectively preclude access to meetings by members of the general public who wish to bring specific issues before a governmental body. See Hough v. Stembridge, 278 So. 2d 288 (Fla. 3d DCA 1973). And see Yarbrough v. Young, 462 So. 2d 515 (Fla. 1st DCA 1985) (posted agenda unnecessary; public body not required to postpone meeting due to inaccurate press report which was not part of the public body's official notice efforts). Thus, the Sunshine Law has been interpreted to require notice of meetings, not of the individual items which may be considered at that meeting. However, other statutes, codes or ordinances may impose such a requirement and agencies subject to those provisions must follow them. Accordingly, the Sunshine Law does not require boards to consider only those matters on a published agenda. "[W]hether to impose a requirement that restricts every relevant commission or board from considering matters not on an agenda is a policy decision to be made by the legislature." Law and Information Services, Inc. v. City of Riviera Beach, 670 So. 2d 1014, 1016 (Fla. 4th DCA 1996). Today's Coastal Advisory Committee Clam Bay Subcommittee was properly noticed in compliance with the Sunshine Law on or about February 1, 2010. Further, the agenda for today's meeting was also publically noticed on the County's website on Monday, March 15, 2010. The related back-up materials for the agenda were supplemented and available on the County's website on Wednesday, March 17, 2010. In addition, a number of these materials also appeared on the agenda for the Coastal Advisory Committee meeting on Thursday, March 11, 2010. Public Comments None VI. Approval of CAC Minutes 1. May 9,2013 Mr. Rios moved to approve the minutes of the May 9, 2013 minutes subject to the following change: • Page 3, paragraph 2—from line 4 -5 from "...Success without S at Wiggins Pass"... to "Success at Wiggins Pass..." Second by Ms. Roddy. Carried unanimously 6—0. VII. Staff Reports 1. Expanded Revenue Report—Gary McAlpin The Committee reviewed the "Collier County Tourist Tax Revenue FY 13 TDC Revenue Report"dated through May 2013. 2. Wiggins Pass Straightening—Update Mr. McAlpin reported the work required to remove the rock outcropping is still underway and is expected to be completed this week. Mr. Moreland reported the area has seen environmental improvement with the seagrasses and oyster beds. There are plans underway for a public event to be held in the fall recognizing environmental improvement to the Pass. 3. Erosion Control Structures at Marco South Mr. McAlpin reported the beach renourishment and work on the jetties has been completed. Work continues on the breakwater structures with completion anticipated in approximately 2 months. CAC September 12,2013 VII-1 Staff Reports 3 of 5 Laser Grading Mr. McAlpin reported the project was timed out by turtle nesting season and the area will be reviewed after turtle nesting season to determine any further work necessary. 4. Doctors Pass Update Mr. McAlpin reported: • The County has received the amended permit from the US Army Corps of Engineers. • He anticipates the Florida Department of Environmental Protection Permit to be issued by July 1, 2013. • The development of plans and specifications is underway. • The bid package will be released to the public after all permits have been issued. • It is anticipated the project will be completed by November 1, 2013. VIII. New Business 1. Beach Renourishment Gary McAlpin presented the Executive Summary "Update the CAC and TDC relative to bid No. 13-6067R to renourish the Vanderbilt, Pelican Bay, Park Shore and Naples Beaches via a off shore sand source utilizing hopper dredges along with presenting alternatives for consideration and solicit Advisory Board recommendations"dated June 20, 2013 for consideration: He reported: • The County previously requested bids for the major beach renourishment project from truck haulers and dredgers with bids being received from truck haulers only. • The County deemed the truck haul bids unqualified and decided to release a second request for bid for the major beach renourishment for response by dredge contractors only. • The County received one bid from the request from Great Lakes Dock and Dredge (GLDD) at $32M. • The large bid amount is due to the high demand for dredging projects including those necessary to repair major storm damage in the northeastern portion of the country and projects approved by the US Army Corps of Engineer in other regions. • The County's budget for the project is approximately$15M and based on the bid received, the following options are being considered: 1. Work with GLDD to evaluate and eliminate, if possible the "High Cost Obstacles and Risks"to reduce the bid price. Some of these might be: • Alternate material screening methods to eliminate dredge screening and downtime. • Eliminate pipeline relocations. • Dredging/renourishment when capacity is available. • Other methods of renourishment in "low fill volume"areas. Reject the GLDD bid and postpone dredging for a year but be prepared to perform emergency truck haul renourishment to deal with critical hot spots as they develop. • This would also include a permitting update component. 3. Reject the GLDD bid and rebid the project utilizing a modified truck haul approach and extremely close coordination with the City of Naples. This project would begin as soon as turtle nesting season ends or the beaches become available and continue until 5/1/2014. Dual sand mines, dual haul/placement contractors and multiple discharge locations on the beach would be required along with approval to stockpile screened sand prior to placement. This approach would be difficult but would be doable with coordinated planning and cooperation by all stakeholders. Discussion occurred on the options proposed including the rationale for the bid amount, the probability of prices decreasing next year, impacts of truck haul renourishment on turtle nesting season, traffic impacts, potential beach access points for the truck haul, etc. Chairman Sorey reported the preliminary conversations with representatives and citizens of the City of Naples indicate a truck haul project, which was previously opposed is "better than no beach renourishment at all." The scope of work would need to incorporate constraints to manage vehicular and pedestrian traffic and possible remediation to any damages on area roadways/bridges, etc. caused by the activity. Speaker Bob Krasowski addressed the Committee supporting Option #3 and recommended, given the cost estimates garnered for dredging renourishment, future workshops be scheduled engage Stakeholders in developing innovative ideas for beach renourishment. Mr. McAlpin requested the Committee provided a recommendation on which Option should be executed. Discussion occurred recommending the Board of County Commissioners execute Option 1 if the revised price quote is within acceptable budgeted parameters. If not, execute Option 3 for a truck haul project. The Committee was polled on the proposed recommendation with consensus reached to endorse it. Ms. Roddy,Mr. Rios, Chairman Sorey,Mr. Moreland and Mr. Burke voted "yes." Mr. Raymond voted "no." 2. Discussion of"What Promotes Tourism"for Beach Inlet Projects * Ordinance 2013-30: Amending the TDC Ordinance * Resolution 2013-81: Amending TDC Fund Policy CAC September 12,2013 VII-1 Staff Reports 5 of 5 Colleen Greene,Assistant County Attorney provided County Ordinance 2013-30 and Resolution 2013-81 for information purposes. She reported County Staff is in the process of developing criteria to aid in determining if items proposed to be funded with Tourist Tax Revenues"promote tourism." The criteria will be based on County Ordinances and Policies, State Statutes and Attorney General Opinions. Staff will present the proposed criteria to the Committee when they have been developed. Ultimately, the intent is to have the criteria approved by the Board of County Commissioners. IX. Old Business None X. Announcements None XI. Committee Member Discussion Mr. Moreland reported the Estuary Conservation Commission has established a program to monitor Bull Shark activity in Wiggins Pass as local residents have reported spotting them in the area. D 1 CAC September 12,2013 VIII-2 New Business 1 of 4 EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (ITB) 13-6147 Collier County Beach Renourishment Project to Eastman Aggregates (renourishment of Vanderbilt and Pelican Bay) for $3,532,179.99 and Phillips and Jordan (renourishment of Park Shore and Naples Beach) for $5,897,771.27; authorize the Chairwoman to execute two county attorney approved contracts to both firms; make a finding that this item promotes tourism; and approve all necessary budget amendments. OBJECTIVE: To approve the standard construction contracts and budget amendments for Eastman Aggregates to renourish the Vanderbilt and Pelican Bay beaches with a maximum of 95,000 CY's of upland sand for a maximum cost of$3,532,179.99 and for Phillips and Jordan to renourish the Park Shore and Naples beaches with a maximum of 155,000 CY's of upland sand for a maximum price of$5,897,771.27. The overall price for renourishment of the beaches with two (2) contractors will not exceed $9,429,951.26. Make a finding that this item promotes tourism. CONSIDERATIONS: ITB 13-6147 Collier County Beach Renourishment Project was posted on July 24, 2013 with notices sent to 1,704 firms and 64 firms downloading full packages. The solicitation timeframe was abbreviated per the Board of County Commissioners (Board) declaration of an emergency, and consistent with Florida statutes. Four (4) responses were received on the August 8, 2013 due date. Staff is recommending two (2) truck haul/placement contractors to perform the upcoming beach renourishment work. This will allow the project to maximize contractor/hauling resources while focusing effort and expertise to complete the overall project by January 1, 2014. Two (2) contractors will also provide the lowest price combination for the overall project by $202,593.80. The total price for renourishment of the beaches with two (2) contractors will be $9,429,951.26. Bid and Contractor Evaluations: The lowest single bidder, Eastman Aggregates, submitted a price of$9,632,545.06. A historical spreadsheet is attached and marked as Attachment A. Our proposed project is consistent with the sand and fixed cost price for our previous truck haul projects but the hauling and placement price is slightly higher but justified due to schedule constraints, wet beach placement and the potential for liquidated damages. Staff is recommending that Eastman Aggregates renourish the Vanderbilt and Pelican Bay beaches by placing approximately 95,000 CY's of material on these beaches. Eastman Aggregate has performed the three previous truck haul projects in Collier County and has done so without incident. The price for this portion of the project is $3,532,179.99. The Pelican Bay split out quantity of 35,000 CY will cost approximately $1,300,000 and be reimbursed by Pelican Bay. No renourishment of the Pelican Bay beaches will occur without an executed Memorandum of Agreement between Collier County and the responsible Pelican Bay organization(s). Staff is also recommending that Phillips and Jordan, the low bidder for the Park Shore and Naples portion of this project be awarded this work. This portion places 155,000 CY's of CAC September 12,2013 VIII-2 New Business 2 of 4 material on the beach and will cost $5,897,771.27. Phillips and Jordan is a large, family owned company that has been in business for over 60 years. They are located in Zephyrhills and have the capacity and skill to perform this work. They have performed a number of beach renourishment projects in the early 2000's. The most recent was a 120,000 CY renourishment in Brevard County in 2005. They performed a 20,000 CY renourished for Collier County on the Park Shore Beach in 2004 with no apparent issues. They have performed a total of five truck haul renourishment projects. Sand Supply and Mine Operations: Stewart Mine in Immokalee will provide sand for this project. Stewart is stockpiling sand and intends to have 100,000 tons stockpiled by 9/15. Their production rate is 5,000 tons per day and this will be sufficient with the stockpiled sand to meet production needs. Two additional mines are available if conditions warrant. The sand purchase will be a direct pass through from the truck haul/placement contractors to Collier County. Sand costs will be invoiced separately and payable when delivered to the unloading sites on Vanderbilt, Park Shore or Naples beaches. $3,180,000 is the direct purchase price for 375,000 tons of sand for this project. Construction Engineering, Inspection and Project Management: Construction Engineering Inspection (CEI) will be performed by Collier County CZM with direct job bank inspectors and with third party auditing, quality assurance and reporting provided by Atkins Engineering. Overall CEI is expected to cost less than $200,000 with full time inspection at the mine, the beaches and each of the three unloading operations. Coastal Planning and Engineering (CP&E) will perform field engineering and quality control inspections and will continue to be the Engineer of Record and provide project certification at project completion. The pre- renourishment baseline survey for Biological Monitoring is being conducted by CP&E and will be completed prior to the project construction start date. A FDEP preconstruction meeting as required by permit is scheduled for 9/12/2013. Staff is working truck routes, vehicle inspections, staging areas, maintenance of traffic and speed zone enforcement with the Collier County Sheriff's Department and the City of Naples Police Department. Hours of operation will be sunup to sundown, six days a week. No operations will take place the last four days of Thanksgiving week or Christmas week. Staff is seeking Board approval for hours of operation to correspond with daylight hours and Board understanding that with these hours of operation, corresponding construction noise will occur on the beach. Doctors Pass Dredging: Doctors Pass dredging is currently out for bid. Bids were received on 8/30/13. Staff is targeting to award the Doctors Pass dredging contract on 9/24/2013 and completion of the work by 11/1/13 to 11/15/13. Coarser grain sand from the truck haul renourishment will be placed on top of the dredged material from Doctors Pass to obtain a longer beach life. 36,000-38,000 CY's of dredged material is expected to be placed on the beaches south of Doctors Pass at an estimated cost of$738,000. Doctors Pass dredging is independent and in addition to the truck haul beach renourishment south of Doctors Pass. Permit Considerations and Permit Challenge: The United States Army Corps of Engineers (USACE) permit modification was issued on 8/16/2013 without petitioned community or citizen opposition. CAC September 12,2013 VIII-2 New Business 3 of 4 A 10-year Florida Department of Environmental Protection (FDEP) permit is currently valid but will expire on 1/12/2015. Each specific renourishment event and any activities deviating from the original permit conditions require a permit modification. Ten (10) permit modifications have been issued to date and involve everything from authorizing emergency truck haul renourishment events to moving pipeline corridors. The permit was modified for this project and issued on 7/26/2013. FDEP permit activity, sequencing and timing is as follows: • Original permit modification request submitted to FDEP on 11/9/2012. • Request for Additional Information (RAI) submitted to Collier County from FDEP on 12/13/2012. • Collier County response to FDEP's RAI on 3/18/2013. • FDEP deemed Collier County Permit Modification Application complete on 5/3/2013. • FDEP Issued Collier County's Permit Modification on 7/26/2013. • On 8/9/2013, Florida Department of Environmental Protection (FDEP) received a petition for an administrative hearing from a Collier County resident. • On 8/23/2013, FDEP issued an Order Dismissing the Petition with Leave to Amend. The Administrative Hearing petition challenged FDEP's decision to issue a permit modification to Collier County for beach renourishment activities specifically, FDEP's allowing renourishment during the shoulders of turtle nesting season. Turtle nesting season officially begins 5/1 and ends on 10/31 of each year. Actual nesting history from 2007 to 2012 was reviewed and verified. The data this year indicates that all nesting activity has been completed and all except five (5) nests will have hatched by approximately 9/23/2013. Collier County will avoid contact with these nests by bypassing these locations during sand placement. On 8/23/2013, FDEP issued an Order Dismissing the Petition with Leave to Amend. This order provides ten (10) calendar days for the Petitioner to file an amended petition on or before 9/3/2013. If the amended petition is denied with prejudice, the petitioner may then file a motion in the Second District Court of appeals to appeal the FDEP denial. The current plan is to issue the Notice-to-Proceed (NTP) by 9/17/13. Only five (5) turtle nests will remain un-hatched as of 9/23/2013. Beach sand placement will begin on 9/23/2013 with full capacity production by 10/7/2013. Our target is to have this project substantially completed by 1/1/2014 with Liquidated Damages occurring after 2/1/2014. Delays in issuing the NTP as a result of a continued permit challenge will delay anticipated construction completion and Liquidated Damages completion dates accordingly. A late start to renourishment may impact the renourishment quantities. Additionally, if renourishment quantities are reduced by more than 25% below the bid volumes, then new unit prices may have to be negotiated with the hauling/placement contractors. FISCAL IMPACT: In the Tentative FY14 Budget, $15M is budgeted for major County/Naples beach renourishment in TDC Beach Renourishment Fund (195) under Project 80096. In order to proceed with the proposed contract award in September 2013 a budget amendment shifting the project budget from FY14 back to FY13 is required. This budget amendment will reduce reserves and establish FY13 project funding under Project 80096 in the amount of$9,430,000. The FY14 budget for Project 80096 will be reduced to reflect the action taken on this item. This CAC September 12,2013 VIII-2 New Business 4 of 4 revision will be done through a FY14 Budget Resolution presented at the second FY14 Budget Adoption Hearing on September 19. GROWTH MANAGEMENT IMPACT:Ther e is no impact to the Growth Management Plan related to this action. COASTAL ADVISORY COMMITTEE RECOMMNEDATION: The Coastal Advisory Committee recommended on 6/20/2013 to proceed to renourish all the beaches via truck haul as soon as possible with a 5-1 vote. TOURIST DEVELOPMENT COUNCIL RECOMMNEDATION: The Tourist Development Council met on 6/24/2013 voted 5-4 to postpone the dredging for one to two years but perform emergency truck haul as needed. CITY OF NAPLES RECOMMENDATION: The Naples City Council voted on Wednesday, August 21, 2013 to confirm acceptance of the 2013 Collier County Beach Renourishment Project to provide 155,000 cubic yards of sand through truck haul to the Naples Beaches (Park Shore and Naples). This report summarizes the construction and presents the pre- and post-construction surveys required by the Physical Monitoring Plan (PMP) outlined in the Florida Department of Environmental Protection Permit 0235209-003-JC. The Contractor, Cavache Inc., mobilized to the work area on March 1, 2013 and completed demobilizing by April 30, 2013. Collier County completed the beach tilling by April 29, 2013. Based upon the surveys provided by Cavache, approximately 77,800 cubic yards (CY) of sand were excavated from the Caxambas Pass borrow area and placed within the pay template and over 80,000 CY of sand were placed within the permitted fill area between FDEP monuments R- 146 and G-4 (Figure 1). Sand placement began at the southern groin at G-4 and extended northward to approximately 400 feet south of R-146 along approximately 2,300 feet of shoreline. 2.0 SCOPE OF WORK The pre- and post-construction monitoring surveys were conducted using the profile lines at the following monuments: R139 through R-148, G-1 through G-5, K1, and K2. The cross section lines of the borrow area in Caxambas Pass were spaced approximately 100 feet apart. The fill area survey extent was sufficient to compute changes in shoreline at Mean High Water (MHW = +0.44 feet NAVD88) and volume to Depth of Closure (DOC = -11.8 feet NAVD88). The report summarizes and discusses the data including volume and shoreline changes within the project area. All work activities and deliverables were conducted in accordance with the latest update of the Bureau of Beaches and Coastal Systems Monitoring Standards for Beach Erosion Control Projects, Sections 01000, 01100 and Section 01200 where applicable. 3.0 SURVEYS Hyatt Survey Services, Inc. (Hyatt) conducted the pre- and post-construction surveys of beach profiles and the Caxambas Pass borrow area for the PMP. Hyatt's survey reports along with the data disk are presented in Appendix 1. The construction surveys utilized for determining payment and the construction stake-out were conducted by Marco Surveying and Mapping, LLC. 4.0 FILL AREA Appendix 2 presents the profiles measured for the pre- and post-construction R-monument surveys prepared by Hyatt. Table 1 presents the shoreline positions at MHW and the changes in shoreline position equal to the post-construction survey minus the pre-construction survey. Within the primary fill area extending from 400 feet south of R-146 to the northern groin, the average fill width measured at MHW was on the order of 120 feet. Between the two groins, the average fill width measured at MHW was approximately 40 feet. Based on the R-monument surveys, the volume placed from 400 feet south of R-146 to G-4 equated to approximately 72,300 CY. The testing results are presented in Appendix 4 and a summary of the monitoring is presented below. Post Construction URS Corporation Southern (URS) conducted the laboratory testing of four (4) beach sampling locations, one every 500 feet along the placed fill, on behalf of the dredge contractor, Cavache, and Collier County. The results of the post-construction sampling indicate that all of the samples complied with the specifications for silt content and color. Two (2) of the stations, G-3 and R148+158', complied with the Shell Content Specification, 5% retained on the #4 sieve, while two (2) stations, R147+728' and R147+261', did not. Their values were 7.7% and 10.7%, respectively, for percent shell retained on the #4 sieve. The URS report depicts the material retained on the sieve, that being fine, broken shell fragments and small whole shells. Sediment Compliance Collier County conducted additional sampling and testing at 25-foot spacing in all directions (B denotes west, C denotes north, D denotes east, and E denotes south) from the two (2) stations, R147+728' and R147+261' as well as on station (denoted by A) for a total of five (5) samples per each station. The ten (10) samples exceeded the compliance standards exhibiting a range of 5.7% to 16.1% retained on the #4 sieve. Their report depicts the material retained on the sieve, that being fine, broken shell fragments and small whole shells. Native Beach Collier County conducted sampling and testing of the native beach sediment to quantify the shell content of the pre-project conditions. Six samples were taken landward of the fill limits, that is, between the landward limit of the placed fill and the existing dune, at approximate 250-foot intervals in the alongshore direction (denoted by Samples G through L), north of the rock groins. It is noted one (1) sample (denoted by Sample F — Station #148) was collected prior to commencement of construction between the two rock groins and tested at the same time as the other samples, for a total of seven (7) samples. The seven (7) samples exceeded the compliance standards exhibiting a range of 5.8%to 18.2%retained on the #4 sieve. 6 l,/- lc,LU I J South Marco Island Beach Renourishment VIII-3 12 of 76 2013 Post-Construction Report Summary Based on the results of the sediment testing, it is concluded that both the native beach and the placed fill from the permitted borrow area contain areas with higher shell content than the 5% retained on the #4 sieve standard. The range of the shell content within the placed fill is within the range of the shell content of the native beach for pre-project conditions. 7.0 CONCLUSION This report describes the completion of Collier County's 2013 South Marco Island Beach Renourishment Project. Naples, Florida 34104 Re: Joint Coastal Permit -DRAFT South.Marco Island Beach Nourishment Permit No. 0235209-001-JC Sediment Quality Assurance/Quality Control Plan Construction Berm Sample Testing Job#38619-420 Dear Mr. Poff: Please find attached the results of grain size testing for the initial Construction Berm Sample taken to date for the subject project. The beach berm sand samples were sampled by others and were reportedly obtained from a minimum depth of 18 inches within the limits of the in-progress constructed berm. Samples were procured in the field by a representative of the Cavache, Inc. dredging company and delivered to URS. URS mixed and quartered/split the received samples and then forwarded half of the delivered sample to a certified testing laboratory, Radise International Inc. (RAD) for testing. The remaining half sample was forwarded to the Coastal Zone Management Division in Collier Conty. Testing included grain sized distribution testing per ASTM D422-63 (Standard Test Method for Particle-Size Analysis of Soils), fines content determination per ASTM D1140 (Standard Test Method for Amount of Material in Soils finer than No. 200 Sieve) and classification per ASTM D2487 (Classification of Soils for Engineering Purposes). Additionally the Munsell Color Value designations were determined for the sample. We tested each sample to determine if the sand meets the project compliance criteria of maximum 5 percent silt content (passing the No. 230 sieve), maximum 5 percent shell content (retained on the No. 4 sieve) and Munsell Color Value of 6 or lighter. The results of the sieve analysis performed on each sample and the Munsell Color evaluation are attached. All the samples passed the maximum 5 percent silt content criterion. The range was 0.3 to 0.8. All the samples failed the maximum 5 percent shell content criterion. The range was 5.7 to 16.1 percent. All the samples passed the Munsell Color Value criterion of 6 or lighter. We took a photograph of the shell retained on the No. 4 sieve of each sample. We tested each sample to determine if the sand meets the project compliance criteria of maximum 5 percent silt content (passing the No. 230 sieve), maximum 5 percent shell content (retained on the No. 4 sieve) and Munsell Color Value of 6 or lighter. The results of the sieve analysis performed on each sample and the Munsell Color evaluation are attached. All the samples passed the maximum 5 percent silt content criterion. The range was 0.4 to 1.3. All the samples failed the maximum 5 percent shell content criterion. The range was 5.8 to 11 .6 percent. DATE: September 4,2013 SUBJECT: South Marco Beach & Erosion Control Structures Response to Questions from Coastal Advisory Committee CEC FILE NO. 11.122 1.Erosion Losses off the Beach Fill It is well documented in the literature that beach fills undergo profile adjustment during the equilibration process, e.g. the U.S. Army Corps of Engineers Coastal Engineering Manual, Journal of Coastal Research, and Coastal Sediments. These adjustments can be rapid depending upon the site conditions, coastal forcing functions, sediment characteristics, and weather patterns. Beaches that are sediment deprived (sand starved), for example in front of seawalls, can undergo rapid adjustment after renourishment. Taylor Engineering conducted the annual monitoring of the project area from 2002 to 2005, and performed the design and permitting of the 2007 renourishment project. In their design report that accompanied the Joint Coastal Permit Application (Taylor, 2004), Taylor predicted an equilibrium profile adjustment of approximately 20 feet at R-147, 30 feet at R-148/G-1 (just north of the north groin), and 50 feet at G-2 (in-between the two groins). Last time the beach was renourished was in 2007. Based on the Post-Construction Report and First Monitoring Report prepared by Humiston and Moore (H&M) (2007 and 2008, respectively), the following statistics were derived. Approximately 176,000 cy were placed between R-143 and the north groin. Of this volume, approximately 87,900 cy were placed from R-147 to the north groin. No sand was placed between the two groins. The 2007 project underwent the following adjustments after construction. During the first monitoring period, the beach between R-147 and R-148 lost approximately 26,700 cy (equal to 30% of the placed volume), and experienced shoreline erosion at Mean High Water (MHW) ranging from 29 ft/yr to 39 ft/yr. Accretion was documented between the two groins noting no sand was placed directly between the structures. September 4,2013 Page 2 provide stability to the project area, however the breakwater design is intended to allow natural littoral processes at the inlet to occur and periodic renourishment may be necessary. Based on the Second Monitoring Report prepared by Coastal Planning and Engineering (CP&E) (2009), the following statistics were derived. During the second monitoring period, the beach between R-147 and the north groin lost approximately 5,900 cy/yr, and experienced shoreline erosion at MHW ranging from 5 ft/yr to 10 ft/yr. Erosion on the order of 17,200 cy/yr was measured between the two groins, the average shoreline erosion at MHW was 8 ft/yr, and the highest rate of erosion was 25 ft/yr. CP&E stated the rate of shoreline erosion reduced in Year 2 compared to Year 1 as the project underwent initial profile equilibration during the first monitoring period. Based upon documented performance of beach fill projects, the design premise of the South Marco Beach Renourishment Project, and historical monitoring of the Project, the erosion losses experienced to date for the 2013 South Marco Beach Renourishment Project are primarily due to the profiles undergoing the equilibration process. 2. Alternatives Analyses for the Erosion Control Structures Between 2002 and 2005 Taylor Engineering conducted the monitoring and performed the design of the South Marco Beach Renourishment project. As part of their recommendations, Taylor stated that beach restoration is the preferred alternative to mitigate erosion on the south end of the island (Taylor 2003, 2005). In 2008, H&M conducted an evaluation of the Erosion Control Structures. Based upon a comparison of the breakwater surveys from 1996 (post-construction) to 2002 (condition survey) to 2008 (condition survey), H&M observed the crest elevations of the breakwaters have been lowered since their installation. They noted the lowering of the crest is the result of displacement and consolidation of the rock from the crest to the slope or apron which was attributed to the significant storms in 2004 and 2005. Their recommendation was to restore the segmented breakwaters. With respect to the groins, the comparison of the 2008 condition survey and design elevations indicated the groins had not lowered significantly. H&M recommended no action with respect to the groins noting with the breakwaters in place,the groins are adequate for their design purpose (H&M, 2008). In 2011, Coastal Engineering Consultants (CEC) in partnership with Coastal Technology Corporation conducted a numerical model study to evaluate erosion control alternatives for the South Marco Beach Renourishment Project to address the localized erosion of the dry beach documented south of R-147 over time. The scope of work included analysis of historical data; collection of additional survey data; set-up, calibration, and validation of a combined hydrodynamic and morphologic change numerical modeling program; preparation of conceptual designs; and an analysis of alternatives including simulation of the conceptual designs in the modeling program (CEC, 2011). 3106 South Horseshoe Drive,Naples,Florida 34104 Phone(239)643-2324 Fax(239)643-1143 www coastalengi neering.corn CAC September 12,2013 VIII-3 New Business 3 of 3 CEC Project No. 11.122 COASTAL ENGINEERING CONSULTANTS, INC. September 4,2013 Page 3 The conceptual designs included permitted beach fill only; permitted beach fill plus a feeder beach (place additional sand to the north and allow natural processes to transport the sand into the project area), permitted beach fill plus installation of an additional groin cited to the north of the existing groins, and permitted beach fill plus installation of an additional breakwater cited north of the existing breakwaters. Two (2) state-of-the-art models were considered in the study, MIKE21 and Delft3D. Both models were calibrated and performed similarly well predicting tidal elevations, waves, and, to a certain degree, currents. However, the MIKE21 model outperformed Delft3D in more accurately predicting morphologic changes and was chosen to model the developed alternatives. Through numerical modeling it was demonstrated that the additional groin alternative outperformed the other alternatives in terms of sustaining a wider beach in the Project area. However, the model predictions indicated the benefits of an additional groin were localized to the area of influence of the structure. Based upon the model results, engineering judgment, experience of the County and Consulting Team, and the cost to benefit analysis, the additional structure was not justified. Collier County was concerned that our approach to bidding and Invoicing of TS Fay was correct and desired FEMA's opinion/approval of our approach. Our goal was to come to agreement on the approach before any work proceeded. Jesse Munoz and his team indicated that they would be happy to review information and provide feedback but requested that everything be routed through Florida Department of Emergency Management(FDEM)first. I am sending this to you for your review and comment but am also requesting that you also forward this concurrently to Jesse Munoz in Atlanta for review and comment by his team. Since Bob Seibert has FDEM operational control of TS Fay and Margie Petruzzo is our primary contact for TS Debbie, I am passing this request to both of you for your input and immediate forwarding to Jesse Munoz for FEMA's review and comment. TS Fay Attached is our bid form that is currently being bid for TS Fay and a Collier County Alternate#1 for Hot Spot renourishment. Bids are currently due on 8/7/2013 so input time is tight. With this project and form, we have the following clarifying comments: 1. We have changed our renourishment approach from dredged material from an offshore borrow site and placed on the beach through hydraulic renourishment to one of truck haul and dry placement. This is definitely not our preferred method of placement and will involve over 15,000 truck trips over a three month period during the heart of tourist season. Our dredging price of$32,000,000++for what we considered a $15,000,000 project requires this approach. 2. We are looking to renourish our beaches with 250,000 cubic yards of sand or 375,000 Tons. The conversion from cubic yards to tons is a multiplier of 1.5. The hauling industry only deals in tons, so for simplicity,we converted over to their method and developed a bid sheet in tons. 3. Our FDEP permit template will allow for in excess of 500,000 cy's of material to renourishment our beaches and we can justify placing more that 250,000 cy's of material CAC Septemer 12,2013 VIII-4 4 of 5 on the beaches, but community concerns and funding are restricting us in our approach. The ranges of fill placement are listed as R monuments on the bid form. 4. This will be the largest truck haul in the shortest period in Florida history. To maximize our chances of success, we have broken the overall project in two natural subprojects. The first subproject will be the Vanderbilt and Pelican Bay Beaches and the second will be the Park Shore and Naples beaches. We would like each of these subprojects to be awarded to separate contractors with distinct operations and control. However,we will accept one contractor if they are low bidder and can prove to us that they can accomplish the entire project within the required timeframe. 5. TS Fay PW 1146 was approved with an overall renourishment volume of 174,576 cy's for the Vanderbilt, Park Shore and Naples beaches. Collier County plans on placing only 165,000 cy's on these same beaches utilizing truck haul renourishment. 6. The overall project will be bid competitively with a base bid that only includes the TS Fay authorized portion (165,000 cy's) and Alternate#1 bid (85,000 cy's)that includes Collier County Hot Spots for a total of 250,000 cy's. Collier County is expecting FEMA to reimburse the County for the supply,transport and placement of sand for the Base Bid—TS Fay or 165,000 cy's of sand on the TS Fay damaged beaches. Alternate#1 or the Collier County Hot Spots will be the responsibility of Collier County. 7. Collier County will be obtaining Lump Sum pricing for turbidity monitoring, maintenance of traffic and surveys that are directly related to the Base Bid-TS Fay. We would expect FEMA to reimburse Collier County for these expensive as they are directly related to the placement of the 165,000 cy's of sand on the TS Fay damaged beaches. Collier County will also be soliciting lump sum pricing for the Alternate#1-Hot spots renourishment portion of the beaches which is Collier's responsibility. 8. Collier County is expecting FEMA to reimburse Collier County for all mobilization costs. FEMA will be required to mobilize/demobilize equipment for TS Fay regardless if Collier performs any work. No additional equipment will be required to complete the work for Alternate#1-Hot Spots which is Collier's responsibility. All mobilization/demobilization costs are included in The Base Bid-TS Fay. 9. Collier County is requiring the successful bidder to invoice Collier County independently via separate invoices for both the Base Bid—TS Fay and Alternate#1—Hot Spots. Collier County will request reimbursement from FEMA utilizing the independent Base Bid invoice. 10. Engineering work began on the combined TS Fay and Collier County Hot Spot project before the completion date was extended to 12/31/2014. Until this extension, Collier was unsure if the TS Fay work extension would be granted. The first series of engineering invoices were not split out to separately between the TS Fay scope and the Collier County Hot Spot scope because of this. These initial invoices were not forwarded to you for reimbursement because Collier was not sure of the proration approach. After the extension of TS Fay was granted, all engineering invoices have be split out and invoiced separately by the engineering consultant and we have requested reimbursement for these separate invoices. We are proposing that the engineering invoices that have not been forwarded for reimbursement because tasks have been co-mingled between TS Fay and Collier County Hot Spots be prorated based on the quantity of sand for the TS Fay Base Bid (165,000 cy's) and the total project quantity of sand (250,000cy's). If obligation is accomplished in sufficient time to complete TS Debbie's renourishment concurrently with TS Fay,the County would propose: 1. The cubic yards obligated per beach section for TS Debbie be added to the quantities listed above. The overall quantity of the project would most likely increase but the County's portion of the project might decrease depending on where the sand was authorized and if it covered a Hot Spot location slated for renourishment by the County. The exact project totals and split between TS Debbie and the County would not be known until a quick analysis can be performed. Collier County would not expect the Totals for TS Fay to change. 2. Collier County would issue a change order to the selected contractor to perform this work at the competitive pricing that are currently being bid for TS Fay. Pricing for additional maintenance of traffic, surveys and turbidity monitoring will be obtained and verified against the bid line items for the TS Fay and Alternate#1 Hot Spot pricing. Mobilization costs will be prorated between TS Debbie and TS Fay. 3. All contractor invoicing and reimbursement requests for TS Debbie will be separate and distinct from TS Fay.
