Horseshoe Drive, Naples, Florida, with the following members present: Clay Brooker Robert Mulhere Alexis Crespo (Excused) ALSO PRESENT: Heidi Ashton-Cicko, Assistant County Attorney Caroline Cilek, M.S., Senior Planner, LDC Coordinator Ellen Summer, Planning Technician Dom Amico — CBIA Tim Hancock—Davidson Engineering Jeremy French — Conservancy of Southwest Florida 1 February 28, 2013 1) Approve Meeting Minutes from Thursday January 24, 2013 The minutes of the January 24, 2013 meeting were approved and signed by Clay Brooker. 2) Review of Changes Made from Last Meeting Ms. Cilek reported Staff incorporated changes recommended from the last meeting into the draft as necessary. 3) Next Meeting Date Availability. Friday, March 22, 2013 3:00pm—or- Friday, March 29, 2013 3:00pm The next meeting is to be held on March 27, 2013-3:00pm. Ms. Cilek will confirm if that date will work. 4) Review of Administrative Code and Corresponding LDC Amendments Ms. Cilek reported the meeting packet includes the following documents: a. "DSAC-LDR Subcommittee Review -LDC Amendment Packet for Administrative Code"—February 21,2013 b. "Land Development Regulations-Administrative Code- Drafi"—February 21, 2013 (Chapters 3 and 4) The Subcommittee reviewed the draft chapters of the Administrative Code and discussed the topics listed below. When necessary, Staff made real time notes to the Draft based on input from the Subcommittee members and participants. The following was highlighted: Mr. Mulhere arrived at 3:20pm Chapter 3 of Administrative Code • DRI —Staff to review DRI Amendment section in the LDC Amendment to ensure that we are not removing the requirements for public hearings. Do not want any unintended consequences with regards to only referencing the State Statutes in the Admin. Code. • Notification Area—Consideration should be given to developing a"tier approach" for the PUD Notification Area to ensure unwarranted parties are not receiving notifications for PUD amendments that may be minor or insubstantial and will not affect their property. • Approvals—Consider identifying the Board of County Commissioners vote required for approval, "Majority" vs. "Super Majority" on the individual types of applications, where applicable. • Section E.7—Consider including a process for previously approved PUD's to be able to allow the Board or the Director of Planning and Zoning to make a"comparable and compatible" determination for a proposed use. The CCPC didn't allow PUD documents to include this language between 2004—2006. • Zoning Verification Letter—Review the requirements and process required in the LDC to ensure consistency with the Administrative Code. 2 February 28, 2013 • Page 29, Decision Maker—Recommended for the section_to read "The BCC, following recommendations from both the EAC, if required, and the Planning Commission. Chapter 4 of the Admin. Code • Page 33, #6—Revise text for US Army Corps of Engineers (USACE) and_eliminating-reference to "permit exemptions." The USACE does not provide exemption letters. • Page 35, #3, —Ensure an"Addressing Checklist" should be required for Agricultural Clearing. • Page 37—Determine if requirements 6, 7, and 8 are justified as the information is referenced on the site plans and generally not a requirement for architectural drawings. • Conflicts between regulations— Staff noted if there is a conflict between the LDC and Administrative Code, the LDC is intended to prevail. • Page 45 — Look into whether the South Florida Water Management District issues an Early Work Authorization permit (EWA). • Page 47, Official Interpretation—Include that the applicant shall provide justification for the request and evidence to support their interpretation of the LDC. • Page 69, Zoning Certificate—Clarify definition/requirements for qualifying for a"Home Business" to ensure they are consistent with the LDC. • Page 67—Temporary Uses during Construction—seeking input from Stakeholders such as developers). There being no further business for the good of the County, the meeting was adjourned by the order of the Chair at 4:55 PM.
