• She visited the site to pick up a prescription and passed by several handicap parking
spaces marked by sign posts and parked her vehicle in a space.
• The space she utilized had no sign post in front of it identifying it as a handicapped
parking space.
• Upon exiting the store, she was greeted by Deputy Robins who had issued a citation.
• Upon questioning him, he notified her the sign was posted on the building in front of the
parking space.
• She did not see the sign on the building and there was no sign post. There were non
handicapped spaces immediately adjacent to where she parked which she would have
utilized had she known the space was reserved for handicapped patrons.
• She requested the citation be dismissed.
Deputy Robins testified:
• On routine patrol he observed a vehicle parked in a space reserved for handicapped
patrons and determined the vehicle did not display the proper placard authorizing
handicap parking.
• There is a sign on the wall in front of the space and the space marked with a"wheel chair
emblem" on the pavement within the space.
Neither party was able to produce any photos of the incident or scene.
Code Enforcement Supervisor Christina Perez located visuals of the scene via the computer.
The parties reviewed the images.
Deputy Robins and Ms. Gilio disagreed on the location of the parking space in question.
Upon hearing the testimony, the Special Magistrate took the case UNDER ADVISEMENT in
order to make a site visit.

Jake Albright was present and testified:
• On March 17, 2013 he was washing his motorcycle in the driveway with his dog
"Brownie" secured by a leash in an open garage.
• The dog had a narrow view of the streetscape due to his parked truck and motorcycle.
• Neighbor, Daniel Harrity was walking his small dog "Mamie" along the sidewalk when it
appeared within Brownie's narrow field of vision.
• Upon seeing Mamie, Brownie broke free from his collar and attacked the neighbor's dog.
• He immediately arrived on the scene where Mr. Harrity had managed to extricate Mamie
from Brownie's mouth.
• He presumes Brownie thought Mamie was a squirrel and chased her.
• To his knowledge Mamie only required sutures and medication.
• Brownie was adopted from a shelter and has had no previous incidents of aggressive
behavior; according to the Ordinance, more than one incident is required to deem a dog a
"Dangerous Dog."
• Officer Rygel visited Mr. Albright's residence with Brownie present and could attest that
the dog did not act aggressively in her presence.

• She was notified of the incident and investigated accordingly.
• She did visit Mr. Albright's residence and during the visit Brownie did not act aggressive
towards her.

• She did not ascertain any photos of Mamie's injuries as the dog had passed away.
• After reviewing the incident Brownie was declared a"Dangerous Dog."

Discussion occurred on the statement by Mr. Albright that the Ordinance requires more than one

The County adopted the Ordinance on May 21, 2013 and the determination had been made under
the auspices of the previous Ordinance.
Discussion occurred on measures taken by Mr. Albright to ensure no further incidents would
occur.
Mr. Albright reported he now resides at a different location and intends to install a fence around
the yard.
