On February 6, 2009, Respondents were found guilty of violation of the Collier County Code of Laws & Ord., Chapter 22, Article VI, Sec. 22-231, Subs. 1 and 2, for single family residence being occupied without being connected to electricity and water, which violation occurred on the property located at 218 5th Street N.,Immokalee,Florida, Folio#60181000008. 2. An Order was entered by the Special Magistrate ordering Respondents to abate the violation on or before May 6, 2009, or a fine of$50.00 per day would be assessed for each day the violations continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 4429, PG 3245 and attached hereto). 3. Operational costs incurred by the County in the amount of$117.78 have been paid. 4. Respondent, having been duly noticed for the public hearing regarding the County's Motion, was represented by Irene and Rosa Mancha,the beneficiaries of the estate, at the public hearing. They failed to present a legal defense to the Motion, but presented mitigating circumstances affecting compliance. 5. No Request for Re-hearing or Appeal pursuant to Ordinance 07-44 has been timely filed. 6. The violation has been abated as of June 30,2009. ORDER Based upon the foregoing Findings of Fact and pursuant to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No.07-44, it is hereby ORDERED: A.
