""'°" Naples, Florida, January 24, 2013 LET IT BE REMEMBERED, the Collier County Development Services Advisory Committee Administrative Code Subcommittee in and for the County of Collier, having conducted business herein, met on this date at 3:00 P.M. in REGULAR SESSION at the Collier County Growth Management Division Building, Conference Room #609/610, 2800 N. Horseshoe Drive, Naples, Florida, with the following members present: Clay Brooker Misc.Corres: Robert Mulhere Date: Alexis Crespo Item#: Copies to: District I District 2 District 3 District 4 District 5 ALSO PRESENT: Heidi Ashton-Cicko, Assistant County Attorney Caroline Cilek, Senior Planner Ellen Summer, Planning Technician Bill Schreck, The Henning Group Dom Amico, ABB/ CBIA Patrick Vanasse, RWA Jeremy Frantz, Conservancy of Southwest Florida 1 January 24, 2013 1) DSAC Subcommittee Overview a) Review of Administrative Code i) Direction from BCC (1) Ms. Cilek provided an introduction noting a draft of the Collier County Administrative Code was prepared by consultant Mark White. Staff will be modifying the draft to fit the needs of the County and present it to the Board of County Commissioners for review and approval. ii) LDC Amendment and types of changes (1) Ms. Cilek reported there are three types of changes envisioned during the review process: (a) Correcting typos/inconsistencies/errors associated with the LDC made during the drafting of the Admin Code and LDC documents. (b) Global changes which are recommended by staff to be made and will be identified when the documents are presented to the BCC. Changes may be in one or both documents. (c) Changes recommended as a result of Advisory Board reviews of the document, envisioned for the next LDC Cycle. b) Recommendations to Full DSAC i) During its review of the draft Administrative Code and LDC amendments, the LDR Subcommittee will be formulating recommendations to be forwarded to the full DSAC to approveand recommend to the BCC. c) Public Participants i) The meetings are open to the public with participation welcomed from building industry, environmental consultants, and other interested parties. d) Next Meeting Date i) To be determined. 2) Review of Administrative Code and Corresponding LDC Amendments a) Ms. Cilek reported the meeting packet includes the following documents: i) "LDC Amendment Packet for Administrative Code—Prepared Tuesday, January 15, 2013" ii) "Collier County Administrative Code Draft—DSAC LDR Subcommittee Review— Thursday, January 24, 2013— Chapters 1,2,3 [partial], and 8. " The LDR Subcommittee reviewed the draft of the Administrative Code and discussed topics including but not limited to the points listed below. When necessary, Staff noted the changes to the draft based on input from the LDR Subcommittee members or public participants. 2 . r January 24, 2013 Discussion points Chapter 1 • It is proposed that the Administrative Code is adopted as a Resolution, as opposed to an Ordinance, to allow changes to be made by presenting prepeses-to the BCC on the consent agenda. ~ 0 5S • Patrick Vanasse suggested that changes to website lints and contact information should be allowed to be done administratively. Chapter 2 • Staff to ensure the notifications periods are consistent throughout the document for providing notices "at least 15 days prior" as opposed to the absolute "15 days prior." • Consider incorporating"property owners in the notification area"as a defined term in the document and consistently identify these terms in bold and/or capitalized. • Consider formatting the document so all applicable requirements for an individual category of a comprehensive plan amendment is identified in their own section, i.e. one section for"small comp. plan amendments"and another section for"regular comp. plan amendment." Chapter 3 • Intro to Chapter 3- consider formally defining the parties deemed to have "legal standing" in regards to land development applications. • Consider alphabetizing each chapter for easy reference. An alternate concept is to itemize them from most frequent petition to least frequent petition. Alphabetizing was decided as the best method for organizing each chapter. • Consider re codifying the process for appealing Planning Commission decisions in the Land Development Code. Currently, it is not identified in the Code of Laws or the LDC. • Consider adding the Appeals language to the Mixed Use Projects - Administrative Approval petition section. • Consider removing the text for the DRI Amendment section and solely reference the State Statute. Mr. Mulhere left the meeting at 4:35pm Mr. Mulhere returned at 4:45pm Ms. Crespo left the meeting at 4:45pm Ms. Crespo returned at 4:50pm 3 January 24, 2013 Chapter 8 • Staff to review and make changes based on discussions today. • Ms. Cilek reported she will incorporate any necessary changes into the document for review by the Subcommittee. • She requested LDR Subcommittee members review the LDC Amendment packet and submit comments for review by Staff. There being no further business for the good of the County, the meeting was adjourned by the order of the Chair at 5:10 PM.
