OF PROPERTY HEREINAFTER DESCRIBED
IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125
Florida Statutes, has conferred on all Counties in Florida the power to
establish, coordinate, ane. enforce zoning and such business regulations
as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Comprehensive
Zoning Ordinance establist.ing regulations for the zoning of particular
divisions of the County, :among which is the granting and extending the
time period of Provisional Uses; and
WHEREAS, on December 17, 1985, the Board of County Commissioners
enacted Resolution No. 85 -270, which granted a provisional use pursuant
to Ordinance 82 -2, provisional use 8.10 (b) of the A -2 Zoning District
for a resource recovery plant located at the Naples Landfill,'on the
below described property; and
WHEREAS, Section 13, Paragraph 1, Subsection E provides that the
Board of Zoning Appeals may'grint an extension of the one (1) year time
period for a provisional use which has not been commenced;
NOW, THEREFORE. BE IT RESOLVED by the Board of Zoning Appeals of
Collier County, Florida, t_nat the written request of Robert Fahey,
representing the Board of County Commissioners, in interest of the
following described property:
The Northerly 650 feet of the Southerly 850 feet
of the Westerly 660 feet of the Easterly 860 feet,
Section 36, Township 49 South, Range 26 East,
Collier County, Florida, containing 9.848 acres
more or less
is hereby approved pursuant to Section 13.1(e), Ordinance No. 82 -2, and
the expiration date for the provisional use 8.10 (b) of the A -2 district
is hereby extended for one year until December 17, 1987.
BE IT FURTHER RESOLVEU that this Resolution be recorded in the
minutes of the Board and in the records of the Petition for which the
extension is granted.

Commissioner Voss offered the foregoing Resolution and
moved its adoption, seconE.ed by Commissioner Goodnight and
upon roll call, the vote vas:
AYES: Commissioners Voss, Goodnight, Hasse and Pistor
NAYS: Cannissioner Hollwid
ABSENT AND NOT VOTING: None
ABSTENTION: None
