ORDER ON MOTION TO CONTINUE THIS CAUSE came on for public hearing before the Special Magistrate on October 3, 2008, and the Special Magistrate, having considered the matter and being duly advised in the premises, hereupon issues its Findings of Fact, Conclusions of Law, and Order of the Special Magistrate, as follows: FINDINGS OF FACT 1. Respondent is charged with violation of the Code of Laws & Ordinances, Chapter 142, Sections 142-33(J), 142-34, 142-37(B), by allowing an employee to operate a vehicle for hire without first obtaining a driver ID issued by Collier County Code Enforcement. 2. Respondent, Clean Ride Limo, Inc., was present in the person of its owner, Bobby Calvert, and was represented by its' attorney, Brandon Perkins, Esq. 3. Code Enforcement Investigator Michaelle Crowley was present on behalf of Petitioner and was represented by Assistant County Attorney, Jeffrey Wright, Esq. 4. This matter was continued from the September 19, 2008 hearing to today's date to permit the parties the opportunity to submit documents and legal authority to support each side's argument regarding the application of the above-referenced provisions of the code to the Respondent. 5. Petitioner made an oral motion at today's hearing for a continuance for the purpose of reviewing Respondent's submittal and for the purpose of supplementing the County's submittal. ORDER Based upon the foregoing, and pursuant to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No.07-44, it is hereby ORDERED: A. The County's Motion for Continuance of this case is granted. B. The County must submit any written supplement by email to the Special Magistrate and the Respondent, with a hard copy to be filed in the official case file, by the end of business day on October 13, 2008. The Respondent must submit any written supplement by email to the Special Magistrate and the County, with a hard copy to be filed in the official case file, by 12:00 noon on October 16, 2008. C.
