On January 18,2008,Respondent,Gilda Navarro,was found guilty of violation of the Florida Building Code,2004 Edition, as amended, Sections 424.2.17.1 to 424.2.17.1.8, as adopted by the Collier County Code of Laws and Ordinances,for having a swimming pool without a fence or an appropriate enclosure,which violation occurred on property located at 9741 Campbell Circle,Naples,FL 34109, Folio#29381160006. 2. An Order was entered and recorded in Collier County,FL at O.R.Book 4336,Pages 2607-2609, in which the Respondent was ordered to abate the violation on or before January 25,2008, or a fine of$100.00 per day would begin to accrue. 3. Respondent,Gilda Navarro,did not abate the violation prior to the public hearing and did not abate the violation prior to the deadline of January 25,2008,but no Motion to Impose Fines/Liens was filed by the County and no fines have been assessed. 4. In a separate action,Countrywide Bank,FSB commenced a mortgage foreclosure action against the Respondent, Gilda Navarro,which concluded with a Summary Final Judgment of Foreclosure, a foreclosure sale and the issuance of a Certificate of Title on May 28,2008 in favor of Countrywide Bank,FSB,recorded in Collier County,FL at O.R. Book4364,Page 3257. 5. Countrywide Bank FSB was not a party to this action at the time of entry of the Order to abate the violation and the violation remained as of the date that Countrywide took title to the property pursuant to the foreclosure action. 6. A re-inspection that was performed by Code Enforcement on September 18,2008 revealed that the corrective actions of erecting a permanent protective barrier and obtaining a Certificate of Completion as ordered by the Special Magistrate have been performed by Countrywide as of September 18,2008. ORDER Based upon the foregoing,and pursuant to the authority granted in Chapter 162,Florida Statutes, and Collier County Ordinance No.07-44, it is hereby ORDERED: A. The County's Motion to Vacate the Order of the Special Magistrate entered on January 18,2008 and recorded at O.R. 4336,Pages 2607-2609 is granted and said Order shall have no effect. We own property at 81 Dolphin Circle, Naples. On April 21 we took a copy of our tax bill to obtain a beach sticker. We then proceeded to the parking lot near Marco South where we had parked in the past after paying$6.00. When we paid the$6.00 in the past,we placed the parking receipt where the sign told us to, on the dashboard in view. The beach sticker we obtained did not indicate where it was to be placed. The kind gentleman that provided the sticker did not indicate where it was to go. We therefore left the sticker on the dash where we had placed the receipt in the past. When we came back from the beach we had the above ticket.We obviously had the sticker as the ranger saw it. We ask that the ticket be dismissed because we had the sticker and were simply following the instructions that are posted in the parking lot. The next day when we went to the beach we looked at other vehicles and saw that the sticker was placed on the rear bumper. NEIL WALMSELY, Respondent. / PRELIMINARY STATEMENT This Memorandum of Law is filed on behalf of Respondents, Clean Ride Limo, Inc., Bobby D. Calvert, and Neil Walmsley. Because there are no genuine issues of material fact in dispute, Respondents respectfully request that the Special Magistrate find them not guilty as a matter of law. At issue, is whether 26 and 28-passenger commercial motor vehicles are subject to Collier County's Vehicle For Hire Ordinance when such vehicles are: (1) defined as buses under Florida Law; (2) regulated by the U.S. Department of Transportation; (3) have a U.S. DOT number assigned to them; and (4) may only be operated by a driver holding a valid Commercial Driver's License with a passenger endorsement. STATEMENT OF FACTS Bobby Calvert and Neil Walmsley both hold Commercial Driver's Licenses and drive vehicles for Clean Ride Limo, Inc. The vehicles at issue are a 26-passenger Hummer (Exhibit A) and a 28-passenger Escalade (Exhibit B). Both vehicles are regulated by the Florida Department of Transportation and U.S. Department of Transportation. Both vehicles are marked with a DOT numbers assigned to Clean Ride Limo, Inc. 1 In addition, Clean Ride Limo, Inc. operates a 38-passenger rectangular- shaped vehicle. (Exhibit C). Collier County concedes that the Vehicle for Hire ordinance does not apply to the 38-passenger rectangular shaped vehicle. ' Clean Ride Limo Inc.'s U.S.DOT.number is 1698878FL. 2 SUMMARY OF ARGUMENT A 26-passenger, DOT regulated vehicle, driven by a person holding a Commercial Driver's License and acting under the authority of that license, and under the regulations of the Department of Transportation, is exempt from the Collier County Vehicle for Hire ordinance. During the Public Vehicle Advisory Committee (PVAC) meeting on April 10, 2002, the drafters of the 2001 Vehicle-for-Hire ordinance explained the scope of the exemption. Michelle Arnold, a code enforcement officer, and contributor to drafting the Vehicle for Hire ordinance, expressly stated that "[t]he exemption is if its regulated by someone else, [] they wouldn't have to be certified by us."2 Assistant County Attorney Thomas Palmer explained: "[w]hat we're interested in to find if somebody is seeing to it that these are good vehicles with proper insurance."3 Mr. Palmer went on to explain rhetorically, "[i]s some governmental entity doing that kind of thing? We don't want just these wildcards out there.i4 Chairman Pease summed up the exemption by stating that if a company"fell under DOT, DOT would take would take precedent."5 Prior to 2001, the Vehicle for Hire ordinance contained a qualified definition of the word "limousine." Specifically, limousine was defined as a vehicle with a seating capacity of less than 14 passengers, exclusive of the driver. The 14-passenger qualification was removed from the definition of "limousine" to close a perceived loophole whereby a vehicle would be too large to be regulated under Collier County's ordinance, and too small to be regulated by the Department of Transportation. Notwithstanding the broadening of the term "limousine," Code Enforcement Officer Michelle Arnold unequivocally maintained, "if its regulated by someone else, [] they wouldn't have to be certified by us."6 PVAC understood that the common meaning of the term "limousine" was a stretched passenger vehicle with a seating capacity of less than 15, inclusive of the driver. Even the Florida Legislature qualified the definition of "limousine" as a vehicle with a 2 PVAC Meeting Minutes,April 2002. 3 Id. 4 Id. 5 Id. 6 Id. 3 seating capacity of 15 or less, when it passed Special Law 2001-299, codifying the creation of the Hillsborough County Public Transportation Commission. What is less clear is why the number 15 seems to be a magic number when classifying and regulating vehicles. The answer to this question lies in the definition of the term "Commercial Motor Vehicle," which, by definition, includes for-hire vehicles with a seating capacity of more than 15, inclusive of the driver. Commercial Motor Vehicles are regulated by the Florida Department of Transportation and U.S. Department of Transportation. Collier County cites to section 125.01(1)(n), of the Florida Statutes, as its authority to regulate limousines. Section 125.01(1)(n) expressly authorizes Counties to license and regulate taxis, jitneys, limousines for hire, rental cars, and other passenger vehicles. Understanding the State of Florida's overall classification scheme for vehicles, and using the common meaning of the terms taxi, jitney, limousine for hire, rental car, and passenger vehicle, it is doubtful that section 125.01(1)(n) authorizes Counties to regulate vehicles with a seating capacity of more than 15 passengers, inclusive of the driver. Lastly, Collier County's interpretation of the Vehicle for Hire ordinance would lead to the absurd result of requiring SUV-looking vehicles to be certified, but allowing rectangular-shaped vehicles to be exempt. To be sure, Collier County has always exempted rectangular-shaped buses from the ordinance. Therefore, the County's position seems to be: If it seats 26 and is rectangular in shape—the County doesn't regulate. But if it seats 26 and is shaped like an SUV—the vehicle has to be certified by the PVA-C. 4 ARGUMENT I. COLLIER COUNTY'S VEHICLE FOR HIRE ORDINANCE DOES NOT APPLY TO A 26-PASSENGER, DOT REGULATED, COMMERCIAL MOTOR VEHICLE, DRIVEN BY A PERSON HOLDING A COMMERCIAL DRIVER'S LICENSE, WHEN THE DRIVER IS ACTING UNDER THE AUTHORITY OF THAT LICENSE AND PURSUANT TO THE REGULATIONS OF DOT,BECAUSE: A. THE DRAFTERS OF THE VEHICLE FOR HIRE ORDINANCE NEVER INTENDED TO REGULATE VEHICLES THAT WERE ALREADY SUBJECT TO DOT REGULATIONS; B. THE DRAFTER'S AMENDED THE DEFINITION OF THE TERM "LIMOUSINE" TO ENSURE THAT EVERY VEHICLE FOR HIRE WAS REGULATED BY PVAC OR DOT,BUT NOT BOTH; C. THE FLORIDA LEGISLATURE'S DEFINITION OF THE TERM "LIMOUSINE"IS LIMITED TO VEHICLES WITH A SEATING CAPACITY OF 15 OR LESS; D. ANY FOR-HIRE VEHICLE WITH A SEATING CAPACITY OF MORE THAN 15 MEETS THE DEFINITION OF COMMERCIAL MOTOR VEHICLE; E. AN ABSURD RESULT WOULD OCCUR IF COLLIER COUNTY'S POSITION IS ADOPTED. A. The Drafters Never Intended The Vehicle For Hire Ordinance To Apply To DOT Regulated Vehicles The Collier County Vehicle for Hire ordinance specifically excludes "transportation activities licensed by . . . any [1 government or agency of any government so long as such vehicles are engaged in . . . activities authorized by the respective license." Sec. 142-28(b). Shortly after amending the Vehicle for Hire ordinance, PVAC discussed the scope of this exception. In the April 10, 2002 meeting of the Public Vehicle Advisory Committee, the following exchanges took place regarding the exception to the Vehicle for Hire ordinance. MR. CSOGI: . . . there's a ton of buses going around for assisted living communities, and a lot of the people aren't disadvantaged or handicapped, 5 but they take them shopping and everywhere. Is that under [the ordinance] . . . or are they exempt. CHAIRMAN PEASE: Well, Item E of page 5 says that "vehicles limited providing transportation services for the transportation disadvantaged." MR. CSOGI: Yeah. But these aren't disadvantaged. These—these are just a–a service that the home provides. MS. BAISLEY: But we're talking about buses, and we don't regulate buses. CHAIRMAN PEASE: But those are – those are mini-coach weight, but they are not mini-coach capacity. MR. CSOGI: Right. And we – we amended the bylaws where it used to say up to 14 passengers. Now there's no limit. MR. PALMER: Are those available to, like, paying customers who want to avail themselves of that service? See PVAC Meeting Minutes, April 10, 2002,pg. 52. CHAIRMAN PEASE: . . . the ordinance doesn't specify whether it's paid or unpaid. If they're not an employee, if they're a guest, they would be in violation of the ordinance MR. CSOGI: That's why I'm saying, what about nursing homes? CHAIRMAN PEASE: Nursing homes you get into—I think you get into vehicle capacity, or am I wrong there? MR. HYDE: I thought they were regulated by– MS. ARNOLD: The exemption is if it's regulated by someone else, and they wouldn't have to be certified by us. CHAIRMAN PEASE: I know we checked on the – on the children's day care,but I don't know that–has there ever been any discussion in terms of senior care? MS. ARNOLD: No, not that I'm aware of. MS. BAISLEY: No. How many people do these buses hold? You're saying they're not– 6 MR. WALBURN: They're usually 24-passenger the little mini— minivans. CHAIRMAN PEASE: Regular 25-passenger mini-coaches? MR. HYDE: If I'm not mistaken, I thought they were—I may be mistaken—I thought they were regulated under DOT? CHAIRMAN PEASE: Mr. Palmer, does DOT supersede this county if mini-coaches, 25-passenger vehicles fall under that? MR. PALMER: In all probability any – any outfit that's – that's – that's authorized by a federal agency in all probability supersedes and is exclusive to they federal agency. Although there are instances where you could superimpose little things in top of federal permit requirements, depends on the specific case, and there's a whole myriad of these things. For example, the fact that you've got a federal permit does not mean that there isn't some local jurisdiction around the edges. In other instances the federal jurisdiction is totally preemptive, and if they meet the federal standards, that's it. The government has nothing to say – the local government has nothing to say about it, and there's all kinds of shades of gray here. You have to look at each one of these cases. CHAIRMAN PEASE: All right. I would be in favor of at least directing staff to investigate senior-care facilities and the jurisdiction of the vehicles. MR. PALMER: What we're interested in to find if somebody is seeing to it that these are good vehicles with proper insurance. CHAIRMAN PEASE: Correct. MR. PALMER: Is some governmental entity doing that kind of thing? We don't want just these wildcards out there. MS. BAISLEY: But there are some nursing facilities that use regular vehicles, a town car or a Cadillac to transport– MR. PALMER: Is that available only to their customers? MS. BAISLEY: Yes. MR. PALMER: See, they're not open to the general public. 7 • CHAIRMAN PEASE: That doesn't matter according to out ordinance. MR. CSOGI: Right. MR. PALMER: Well, I know that the — that there — that the applicant — but the question and scope of the application is one thing, and then there are exceptions from that scope. I don't think that we're in the business of regulating things that are available to a limited class of people for no extra charge such as these hotel things. I'm not sure of that. We're interested in people that would make themselves available, like, a common carrier the people who have a right to ask the business and pay a charge. I'd have to look at it in some detail,but we're essentially a—we're regulating common carriers here and things that are available to the general world and not to limited classes of people, such as the patients at a— at a child care facility or something, because they're not holding themselves out to the world as having a service available. CHAIRMAN PEASE: I think we found that the child-care laws covered the aspect of the vehicle. I think the PVAC committee — If I'm hearing it properly — is they're also expressing concern in two areas. One is hotel shuttles that the safety of the guests is being met by the same standards that other carriers are required to provide, and also whether DOT or other— and different organizations, the government, ensures that insurance and other safety aspects for senior-care facilities are being met.And if they are,that's great,we don't have to deal with it. MR. PALMER: If we're — if there's this unregulated area here that nobody's doing it and we kind of do it by default because we're interested in seeing to it that when people being carried around vehicles that their— that their—the vehicles are adequate and at least somebody's looking the vehicles are adequate and the insurance is in place. CHAIRMAN PEASE: So let's direct staff, if you could, prior to our next meeting investigate those two areas. MS.ARNOLD: Okay. Id. at 53-56 MS. BAISLEY: We're getting into the issue of a bus here we're talking about again. We not talking about a van or— MR. CSOGI: Some of them are small. 8 CHAIRMAN PEASE: It's the same-size vehicle as the nursing homes. MS. BAISLEY: A mini-bus that holds 24 people. Are we going to start regulating those, because otherwise there's a lot of people that are in violation by not having permits? CHAIRMAN PEASE: We took the— MR. CSOGI: 14 people out. CHAIRMAN PEASE: They still have to have the permit. MR. HYDE: That's the issue. CHAIRMAN PEASE: That's the kind of question. We're a new territory with a new ordinance, and we're kind of establishing ground here. MS. BAISLEY: You mean, somebody like a transportation company that just has buses still is going to have to have a permit here but not have to pay$50 decal for their buses? Is that what you are saying? CHAIRMAN PEASE: That's a great question. MS. BAISLEY: Because there are a few bus companies that operate here that that's all they have is buses, and they no longer have Collier County permits. CHAIRMAN PEASE: But I think what we said was if they didn't fall under DOT — if they fell under DOT, DOT would take precedent. Those bus companies would fall under DOT therefore would not need a permit from us or any certification. MS. BAISLEY: Doesn't that bus company running to Immokalee fall under DOT? MR. CSOGI: What's the size that DOT takes over? CHAIRMAN PEASE: Over 14. MS. CSOGI: Is it weight or passengers? CHAIRMAN PEASE: And weight of vehicle. Could very well be that they fall under DOT even though they're not doing inter — charter work. Well, they may be doing charter work too. 9 MR. CSOGI: Okay. Need to check on it. Id. at 59-60. See Generally, PVAC minutes,April 10, 2002 (emphasis added)(Exhibit D). As the drafters' comments make clear, if a vehicle is regulated by DOT, it does not have to be certified by the PVAC. The County argues that a DOT number is not a "license" but rather it is merely a "registration with the State."7 Whether it's called a license, permit, certification, or registration is immaterial. The material issue is whether the vehicle in question is regulated by DOT. Here, the 26-passenger Hummer and 28- passenger Escalade are regulated by DOT. The DOT number is a unique identifier that is used by the DOT "when collecting and monitoring a company's safety information acquired during audits,compliance reviews, crash investigations, and inspections."8 In other words, DOT issues unique identification numbers to transportation companies so that DOT can track compliance with DOT regulations. Those regulations require transportation companies to, among other things, maintain insurance and conduct routine safety inspections on their vehicles. What's more, DOT conducts audits and safety reviews. As Assistant County Attorney Tom Palmer stated: [I]f there's this unregulated area here that nobody's doing it and we kind of do it by default because we're interested in seeing to it that when people being carried around vehicles that their — that their — the vehicles are adequate and at least somebody's looking the vehicles are adequate and the insurance is in place. See PVAC Minutes, April 10, 2002,pg. 56. Collier County argues that a DOT regulated vehicle must, not only comply with DOT regulations, but also must comply with the Vehicle for Hire ordinance. Then, the County takes the inexplicable position that a 38-passenger, rectangular-shaped vehicle is exempt from the Vehicle for Hire ordinance because that vehicle is regulated by DOT! Collier County's Argument in Support of County Position. 8 See Exhibit A of the Collier County's Argument in Support of County Position. 10 B. The Drafter's Amended The Word "Limousine" To Ensure That Every Vehicle For Hire Was Regulated By PVAC Or DOT, But Not Both. Prior to 2001, Collier County's Vehicle for Hire ordinance qualified the definition of"limousine" as vehicles with a seating capacity of less than 14, exclusive of the driver. When amending the Vehicle for Hire ordinance, PVAC removed the seating capacity limitation from the definition of the term limousine. The reason that the seating capacity limitation was removed from the definition of limousine was to close a perceived loophole whereby a vehicle would seat too many passengers to be regulated by the Vehicle for Hire ordinance, but seat too few passengers to be regulated by the Department of Transportation. Chairman Pease lamented that the 14-passenger limitation is "creating a loophole where they're not under any jurisdiction or held accountable to Collier County any they're also not held accountable to DOT.s9 The question of whether a 20-passenger vehicle was regulated by DOT was raised. Assistant County Attorney Tom Palmer, asked PVAC whether "somebody pick[s] up the regulation or equivalent of this regulation on a limousine or a large stretch vehicle that exceeds seating capacity of 20 people?"10 Chairman Pease answered Mr. Palmer by stating: "No. DOT on a mini- coach, 20-25 — 20 passenger or more is based on weight really, not length or type of vehicle. So there is a gap here."11 Mr. Palmer then conceded that he did not know all of the "fine lines" and asked "what difference does it make whether it's got 20, 21, 24 passengers unless at some point in time the regulatory authority of this ordinance is subsumed by some other body just because of the seating capacity."12 Thereafter, the seating capacity limitation was struck from the definition of the term limousine.13 By amending the definition of "limousine" PVAC merely attempted to close a perceived loophole whereby a vehicle would seat too many passengers to be regulated by the Vehicle for Hire ordinance, but seat too few to be regulated by DOT. PVAC never intended to regulate vehicles that were already regulated by DOT. This is clear from 9 PVAC minutes,September 6,2001,pg.37(Exhibit E). 10 Id.at 39. " Id. PVAC Minutes, April 10, 2002, pg. 56. C. The Florida Legislature's Definition Of The Term "Limousine" Is Limited To Vehicles With A Seating Capacity Of 15 Or Less. In 2001, the Florida Legislature, enacted a special law directed toward Hillsborough County. In that Special Law, the Hillsborough County Public Transportation Commission is given the authorization to regulate taxicabs, vans, limousines,handicabs,basic life support ambulances, and wreckers. The term"taxicab"is defined as any motor-driven vehicle, equipped with a taximeter, with a capacity for 9 or less passengers, including the driver . . . . The term"van" is defined as: any motor vehicle with a capacity of 10-15 passengers including the driver The term"limousine" is defined as: any motor vehicle for hire, not equipped with a taximeter, with a capacity for 15 passengers or less, including the driver. 2001-299,Laws of Florida. What is clear, at least in this Special Law, is that the legislature uses seating capacity to classify vehicles. The Special Law authorizes Hillsborough County's Public 12 Transportation Commission to regulate "for hire" vehicles with a seating capacity up to 15 passengers. By removing the seating capacity limitation from the definition of "limousine" PVAC never intended to regulate vehicles that are already regulated by DOT. In fact, the County may not have the authority under section 125.01(1)(n) to regulate vehicles with a seating capacity of more than 15 passengers. Collier County cites to section 125.01(1)(n), of the Florida Statutes, as authorization for the County to regulate limousines. Section 125.01(1)(n) permits a County to regulate "taxis, jitneys, limousines for hire, rental cars and other passenger vehicles for hire . . . ." Id. The vehicles listed in 125.01(1)(n) are not specifically defined, but by using their ordinary meaning and the maxim noscitur a sociis the legislative intent can be gleaned. See Nehme v. Smithkline Beecham Clinical Laboratories, Inc., 863 So.2d 201 (Fla., 2003) ("Under the doctrine of noscitur a sociis (a word is known by the company it keeps), one examines the other words used within a string of concepts to derive the legislature's overall intent."). By placing the term"limousine for hire" in the same list as taxi,jitney, rental cars and other passenger vehicle for hire, it is clear the term "limousine for hire" does not include a 26-passenger vehicle. To be sure, Collier County's Vehicle For Hire ordinance defines "taxi" as a vehicle that is "designed to accommodate not more than eight passengers, exclusive of the driver . . . . " Ord. No. 142-26. The common definition of the term "jitney" is a "small bus that carries passengers over a regular route on a flexible schedule." Merriam-Webster Online Dictionary. 2008. Merriam-Webster Online. 13 October 2008 http://www.merriam-webster.com/dictionary/jitney "Rental car" is sedan or van that typically has a seating capacity of less than 15 passengers. The term "passenger car" is defined as "a motor vehicle with motive power, except a low-speed vehicle, multi-purpose passenger vehicle, motorcycle, or trailer, designed for carrying 10 persons or less. 49 C.F.R. 571.3(b). Moreover, the term "multipurpose passenger vehicle" is defined as "a motor vehicle with motive power, except a low-speed vehicle or trailer, designed to carry 10 persons or less which is constructed on a truck chassis or with special features for occasional off-road operation." Id. Based on the ordinary 13 definitions of taxi, jitney, rental car, and passenger vehicle, it is clear that the term "limousine for hire" is limited to limousines with a seating capacity of less than 15 passengers. D. For-Hire Vehicles That Have A Seating Capacity Of More Than 15 Are "Commercial Motor Vehicles" Subject To DOT Regulations,And Therefore, Are Exempt From Collier County's Public Vehicle Ordinance The 15-passenger capacity is an important demarcation. Vehicles with a seating capacity over 15 passengers are classified as "commercial motor vehicles." See Fla. Stat. § 316.003(66)(Commercial Motor Vehicle includes any self propelled vehicle used to transport passengers in commerce if such vehicle is designed to transport more than 15 passengers including the driver). Commercial Motor Vehicles are regulated by the Department of Transportation. See Ha. Stat. § 316.302(b). Drivers of Commercial Motor Vehicles must possess a Commercial Driver's License. See Fla. Stat. § 322.53(1). If the Commercial Motor Vehicle is designed to transport passengers, then the driver must have a passenger endorsement on the Commercial Driver's License. See Ha. Stat. § 322.57(1)(b). By holding a Commercial Driver's License with a passenger endorsement, Mr. Calvert and Mr. Walmsley "may exercise the privilege thereby granted upon all streets and highways in this state and shall not be required by any county, municipality, or other local board or body having authority to adopt local police regulations to obtain any other license to exercise such privilege." Fla. Stat.§ 322.41. As such, Mr. Calvert and Mr. Walmsley do not have to comply with the Vehicle for Hire ordinance when transporting passengers in Clean Ride's 26+passenger, DOT regulated,Commercial Motor Vehicles. Collier County Ordinance, section 142-28 provides for an exemption to local certification for "transportation activities licensed by . . . any government or agency of any government so long as such vehicles are engaged solely in interstate commerce or other activities authorized by the respective license." The U.S. Department of Transportation and Florida Department of Transportation are government agencies that regulate certain types of vehicles. In Florida, a company is required to obtain a U.S. Department of Transportation number and display the number 14 on all of the company's commercial vehicles if the company operates a Commercial Motor Vehicle that "is designed to transport more than 15 passengers, including the driver,for compensation.s14 Clean Ride Limo has complied with section 316.302, by applying for, and obtaining a U.S. DOT number. The DOT number authorizes Clean Ride Limo to transport passengers, for-hire, in intrastate commerce. See Motor Carrier Identification Report (Application for U.S. DOT Number) (Exhibit G). In addition, Mr. Calvert and Mr. Walmsley's Commercial Driver's license contains a passenger endorsement. Therefore, they are authorized to carry passengers, for-hire, in a commercial motor vehicle. What's more, Clean Ride Limo is regulated by 49 CFR parts 382, 385, and 390- 397. See Fla. Sta. §316.302(1)(b). Moreover, Clean Ride is regulated by the Florida Department of Transportation. See Ha. Stat. §316.70. Because Clean Ride's vehicles are regulated by DOT, and operated by drivers holding Commercial Driver's Licenses with passenger endorsements, Clean Ride's transportation activities are exempt from the Vehicle for Hire Ordinance. E. Collier County's New Interpretation Of The Vehicle For Hire Ordinance Leads To Absurd Results It is undisputed that Collier County's Vehicle for Hire ordinance does not apply to a DOT-regulated, rectangular-shaped vehicle that seats 38 passengers. Michelle Crowley has admitted to Mr. Calvert that his "bus" was fine. Ms. Crowley was referring to Clean Ride's 38-passenger, rectangular shaped vehicle. Ms. Crowley, however, cited Mr. Calvert for his transportation activities in his 26-passenger Hummer and 28-passenger Escalade. All three vehicles are regulated by DOT and are considered "buses" as that term is defined in section 316.003(3), of the Florida Statutes. Collier County's interpretation of the Vehicle for Hire ordinance would lead to the absurd result of regulating SUV-shaped buses, but not regulating rectangular-shaped buses.
